The appeal is allowed.  Delete the answers given below to questions A and B and substitute the answer "Proof beyond reasonable doubt" to both.

Delete the answers given to questions C and D and substitute the answer "Yes" to both.

It is further ordered that the respondent is to pay the appellant's costs of this appeal to be assessed.
