An Act to authorise the sale or leasing of cer tain lands ves ted in the Chief Minis ter by the Centenary Celebration A c t ; to amend the said A c t ; and for purposes consequent

thereon or incidental there to . [13th December,
1904.]

WH E R E A S by the Centenary Celebration Act certain lands were his successors, and by section three of that Act power was given vested in the Chief Minister, as defined by that Act, and
to him, after certain portions of the lands had been set apart as prescribed in the Act, to sell or lease the remainder : And whereas it is desirable that certain of the said lands be sold or leased, notwithstanding that such portions have not been set apart as aforesaid: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the " Centenary Park Sale Act,

1904."

2. The Chief Minister may cause any of the lands described in

the Schedule to this Act to be laid out in building sites, and may sell or lease the same or any part thereof by public auction, in such areas, and subject to such conditions as he may think d e s i r a b l e . F o r such purposes the Chief Minister may lay out, construct, and dedicate roads and public places.

In pursuance of any such sale or leasing, the Chief Minister may execute all necessary conveyances, leases, and assurances : Provided that the expenditure incurred under this section shall be a first charge against the proceeds of sale or lease.

3. When any conveyance;, lease, or assurance is made under this Act, the land so conveyed, leased, or assured shall be held free from all prior trusts, conditions, encumbrance's, and dedications, statutory or otherwise, affecting the same other than those created by the said conveyance, lease, or assurance, or by or under this Act.

4. The proceeds of any sale or lease under this Act shall be

paid into the Treasury, and carried to the Consolidated Revenue Fund.

S C H E D U L E .

All those three pieces or parcels of land, in t he county of Cumber land and parish of Alexandr ia , containing an aggregate area of about one hundred and ninety- three acres, herein described, as follows :—First ly , about one hundred and one acres, s i tuated as aforesaid : Commencing a t the junct ion of the nor the rn side of King-st reet with the western side of W e n t w o r t h - s t r e e t , municipal i ty of R a n d wick ; and bounded thence; by t he first-mentioned s t reet bear ing westerly to its junc t ion wi th the north-eastern side of the Randwick-road ; thence by a prolongation of t he nor the rn side of King-s t reet afore­ said, bear ing westerly, across the Randwick-road, before mentioned, to the nor thern boundary of the Randwick racecourse : thence by the nor thern boundary of the said racecourse and the nor thern boundary of the Kens ington Es t a t e bear ing westerly to the eastern boundary of the Sydney Common of four hundred and n ine ty acres, dedicated fifth October, one thousand eight hundred and sixty-six ; thence by pa r t of the eastern boundary of t h a t area bear ing generally nor ther ly to the north-eastern side of the Randwick-road aforesaid ; thence by t h a t road bear ing north-westerly two chains seventy links ; thence by lines bear ing south eighty-five degrees t h i r t y minutes east six chains fifteen links, no r th t h i r t y degrees t h i r t y minutes east about twen ty chains and fifteen l inks to the Centennial P a r k enclosure, being a dwarf wall (as shown upon plan cata­ logued Ms. 1,181 Sy. in the Depar tmen t of Lands) ; thence by t h a t dwarf wall bear ing south-easterly, southerly, and south-westerly, the Centennial P a r k enclosure fence (as shown upon plan catalogued Ms. 1,181 Sy. before ment ioned) bear ing south-easterly, and another dwarf wall of the Centennial P a r k enclosure (as shown upon plan catalogued Ms. 1 , 1 8 1 Sy. before ment ioned) and a line bear ing in all generally north-easterly to the western side of Avoca - s t r ee t ; thence by t h a t s t reet bear ing southerly to the no r the rn side of Ea r l - s t r ee t ; thence by t h a t s t reet bear ing westerly to the north-eastern side of Orange-street ; thence by t h a t s t reet bear ing north-westerly to i ts junct ion with the nor ther ly prolongation of the eastern side of Wentwor th - s t r ee t before ment ioned ; thence by a line bearing westerly to the western side of W e n t w o r t h - street last ment ioned ; and thence by t h a t s t reet bear ing southerly, to the point of commencement, — exclusive of the Randwick-road and Bunnerong-road, wi th in the l imits before described ; also exclusive of the land resumed for t r amway purposes. Secondly, about th i r ty- three acres two roods s i tua ted as aforesaid : Commencing on Park- road, a t a nor th-western corner of the Centennia l Pa rk , as proclaimed s ixteenth February , one thousand nine hundred ; and bounded thence by t h a t road bearing north-easter ly about five chains fifteen l inks to the Centennia l P a r k enclosure, being a dwarf wall (as shown upon plan catalogued Ms. 1,181 Sy. in t he D e p a r t m e n t of L a n d s ) ; thence by t h a t dwarf wall bear ing southerly, south-westerly, and westerly to its intersect ion with a north-western boundary of the Centennial Pa rk , as proclaimed s ix teenth February , one thousand nine hundred , before mentioned ; thence by a line bearing nor th th i r ty degrees t h i r t y minutes east about eight c h a i n s ; thence by a line bear ing nor th twenty- two

degrees east four chains eighty l i n k s ; thence by a line bear ing nor th sixty-eight degrees west th ree chains thir ty-four links to the south-eastern boundary of the Agricul tura l

Society's Ground ; thence by t h a t boundary bear ing nor th fifty-seven degrees six minutes east six chains eleven links ; thence by the eastern boundary of t he said ground, and a line in prolongation thereof bearing nor th three degrees west, in all seven chains fourteen l inks ; thence by a line bear ing north forty-four degrees fifty-six minutes east three chains seventy-three l inks ; thence by a line bearing north twenty- two degrees east s ixteen chains ninety-seven links, to the point of commencement. Thirdly, about fifty-eight acres two roods, s i tuated as aforesaid : Commencing on the southern side of the Sydney to Waver ley t ramway, a t the north-western corner of an area of three roods five perches, being pa r t of St. J ames ' Glebe, t he said point being about two hundred and two links westerly from the junct ion of the western side of S t James ' road wi th the southern side of Waverlev-road : t h e n c e by the western and pa r t of the southern boundaries of t he said area of three roods five perches bear ing southerly and easterly to the western side of St. J a m e s ' road before ment ioned ; thence by t h a t road

W . Smar t ' s four acres two roods g r a n t ; thence by the western boundary of t ha t g r an t to the south-western corner thereof; thence by the southern boundary of the said g ran t and its prolongation easterly, the southern boundary of M. H . and J . Pearse 's four acres two roods g ran t ; thence by pa r t of the southern boundary of t h a t g r an t bear ing easterly to t he north-west corner of A . Quinscy's three acres g r a n t ; thence by the western boundary of t h a t g r an t and a prolongation thereof bearing southerly to the southern side of Victor ia-s t reet ; thence by lines bearing south eighty-nine degrees thi r ty- two minutes west twenty- two chains t w e n t y links, nor th seventy-four degrees twelve minutes west, seven chains seventy l inks and south eighty-nine degrees fifty-eight minutes west about seven chains (the three last-mentioned bearings having a var iat ion of nine degrees th i r ty minutes east of the tr igonometrical meridian) to the Centennial P a r k enclosure, being a dwarf wall (as shown upon plan catalogued Ms. 1 , 1 8 1 Sy. in the Depa r tmen t of Lands) ; thence by t h a t dwarf wall bear ing northerly, north-westerly, and again nor ther ly (as shown upon plan catalogued Ms. 1 , 1 8 1 Sy. before mentioned) to the Sydney to Waver ley t r amway before mentioned ; and thence by t h a t t ramway bear ing easterly, to t he point of commencement. All of which three pieces or parcels of land hereinbefore described are shown upon a plan catalogued Ms. 1.617Sy. in the Depa r tmen t of Lands .
