An Act to make provision for the fitting
celebration of the Hundredth Anniversary
of the Foundation of the Colony and for
other purposes connected therewith. [13th
July, 1887.]
WH E R E A S the appropriation of sites suitable for the purposes of a Public Park (hereinafter referred to as the " Centennial Park") and for the erection of a Building (hereinafter referred to as the " State House") to be devoted to the objects hereinafter specified would be a fitting method of commemorating the Hundredth Anniversary of the Foundation of this Colony And whereas for the carrying out
of such objects and in order that the said Park should be opened and the Foundation Stone of the said Building should be laid on such anniversary it is expedient that authority for the appropriation of such
sites together with certain necessary provisions in connection therewith as hereinafter set forth should be sanctioned by Parliament Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative
Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—
2. Upon the passing of this Act and notwithstanding anything contained in any Statute or in any dedication or notification purporting to vest the lands hereafter referred to or any part thereof in any corporation or persons or to charge or in any way encumber or deal with the same the portions of land described in the Schedules hereto shall together with all buildings or structures that may be now or hereafter erected thereon and the collections deposited therein vest in the Chief Minister and his successors for ever on behalf of Her Majesty for 1. This Act may be cited as the "Centenary Celebration
Ac t " and in its construction the expression " Governor" means the
Governor with the advice of the Executive Council—" Chief Minister" means the member of the Executive Council for the time being com missioned to form an Administration and his successors being members
of the said Council and similarly commissioned.
for the purposes of this Act for an estate in fee simple in possession
freed and discharged from all trusts obligations estates interests con tracts charges securities taxes rates rights-of-way or other easements whatsoever and to the intent that the legal estate therein together with all powers incident thereto or conferred by this Act shall be vested in the Chief Minister And for the purposes of facilitating proceedings in carrying out this Act and giving effect to its provisions generally the Chief Minister shall be a corporation sole and may by that name sue and be sued plead and be impleaded answer and be answered unto defend and be defended and take any legal proceedings in all Courts and places whatsoever with power to bold lands for the purposes of this Act to sell and dispose of lands as hereinafter provided and to give effectual discharges to purchasers thereof and to set apart any portions for roads avenues or for rail or tramways or for lakes ponds
or other ornamental purposes.
3. The lands so vested shall be appropriated and applied to the respective purposes hereinafter set forth—
(a)
A suitable portion shall bo set apart for the erection thereon according to a plan to be approved by the Governor of a Building commemorative of the Hundredth Anniversary of the Foundation of the Colony And such building (to be designated " The State House") shall be designed and con structed so as to provide—
A great Hall or Amphitheatre (to be designated " The Phillip
Hall") for the holding of national assemblages and
commemorative celebrations and services of a national
or special character
A museum (to be designated " T h e Carrington Institute") where shall be deposited as they can be collected all books documents maps printed or written matter and reliques as may be illustrative of the historical material and industrial stages of the Colony's progress and of the various aboriginal races of Australia their customs languages and ethnological characteristics
A gallery for the reception of statues or pictures of the Governors of the Colony and other persons whose names are honourably associated with the Colony
A Public Mausoleum for the interment of those who have
been honoured by a public funeral pursuant to a
resolution of both Houses of Parliament
(b) A portion not being less in area than six hundred and forty acres shall be set apart by the Governor as a Public Park Such park shall be designated " The Centennial Park" and shall be laid out according to plans to be approved by the Governor
but so that the same may be opened to the public on the twenty-sixth day of January one thousand eight hundred and eighty-eight
(c) After such portions have been so set apart the remainder of the lands so vested shall be laid out in building sites and sold or leased by public auction in such areas at such times and subject to such conditions and provisions (including if necessary the description of buildings to be erected thereon)
as the Governor may prescribe
And it shall be lawful for the Chief Minister notwithstanding anything in this or any other Act contained to convey the same to the purchasers
thereof in such manner and subject to such conditions as the Governor
may direct and the proceeds of all such sales or leases shall be paid
by the purchasers to the Colonial Treasurer and shall be by him carried
to the credit of the Consolidated Revenue Fund.
4. Upon the sale or other disposition of any land being portion
of the lands described in the Schedules to this Act no trust obligationestate interest contract charge security right-of-way or other easement from which such land pursuant to section two of this Act is expressed to be freed and discharged upon the vesting of such land in the Chief
Minister shall by reason of such sale or disposition be deemed to revive
Provided that for all purposes of taxation and rating whether public or municipal all lands so sold or demised shall be liable in the same way as ordinary lands alienated by the Crown.5. For the construction of the State House and of the approaches thereto and of all suitable offices in connection therewith and for the laying out planting and enclosure of the Centennial Park and for all necessary works in connection therewith the sum of two hundred thousand pounds sterling is hereby appropriated from the Consolidated Revenue Fund which sum shall be payable by the
Colonial Treasurer in such manner and subject to such conditions as
the Governor may determine.
6. In addition to the said sum of two hundred thousand pounds hereby appropriated a sum not exceeding three thousand pounds to be payable out of the said last-mentioned fund may in each and every year beginning with the year one thousand eight hundred and eighty-eight
be expended by the Chief Minister subject to the approval of the
Governor for the purpose of procuring collections to be deposited in the various departments of the State House and for their due preservation and exhibition Provided that an account of all purchases made by such Minister in each year shall be laid before Parliament.
7. The Governor on the recommendation of the Chief Minister may appoint such Boards of Advice (without remuneration) and mayalso appoint at such annual salaries or other remuneration as Parliament
may sanction such custodians and other officers and servants as he may think necessary for the purposes of this Act and for the due preservation and maintenance of the State House and its collections and of the Centennial Park.
8. The Chief Minister may accept from any person desirous of dedicating or from the representatives of any person who has bequeathed any books pictures documents plans reliques or other things fit in the opinion of such Minister to be deposited in the State House and all such gifts shall when practicable be inscribed with the names of the donors but in all other respects shall be treated in the same manner as if they had been acquired by purchase for the purposes of this Act.
9. No money shall be demanded for entrance to the Centennial Park or State House and the same shall be deemed to be " public places " Provided that the public right of using such places shall be
subject to such regulations as the Governor may think proper to adopt.
10. All collections and articles purchased by given or bequeathed to the Chief Minister for the purposes of this Act or being within or upon the premises or lands by this Act vested in the Chief Minister may for the purposes of all legal proceedings be described as the property of the Chief Minister.
1 1 . I t shall be lawful for the Governor to frame regulations
(which may be enforced by penalties to be summarily recoverable and in no case to exceed fifty pounds for any single breach thereof) for the maintenance of orderly conduct by persons resorting to or using the Centennial Park or State House or any part thereof and for the management and protection thereof Every such regulation when published in the Gazelle shall have the full force of law and shall be construed cumulatively with and not as in substitution of any other law.
