CENSORSHIP OF FILMS
AMENDMENT ACT
No. 18 of 1987
AN ACT to amend the Censorship of Films Act 1947.
[Assented to 25 June 1987]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
Short title
1. This Act may be cited as the Censorship of Films Amendment Act
1987.
Commencement
2. This Act shall come into operation on the day on which it receives
the Royal Assent.

3. In this Act the Censorship of Films Act 1947* is referred to as the
principal Act.

Section 12C inserted
4. After section 12B of the principal Act the following section is
inserted
Exhibition of restricted exhibition films
at certain picture theatres
12C. (1) Notwithstanding anything in section 12, 12A or 12B, where a film is classified as being for restricted exhibition under section 12 or section 12B the Minister may by order in writing prohibit the exhibition of the film, or, the exhibition of such films generally, in
| (a) | any specified chive-in picture theatre; or |
| (b) | any other specified picture theatre where, in the opinion of the Minister, it is possible for a person to observe, from outside the picture theatre, the exhibition of a film inside the picture theatre. |
(2) An order under subsection (1) shall be
| (a) | published in the Government Gazette; |
| (b) | served on the exhibitor of the film at the picture theatre to which the order applies. |
(3) An order under subsection (1) may be revoked or amended by further order made by the Minister and published or served, as the case may be, according to the manner in which the original order was published or served.
(4) Where a film is exhibited at a picture theatre in contravention of an order under this section the exhibitor commits an offence.
Penalty: $5 000.
(5) Where an order is served on an exhibitor under this section a statement signed or purporting to be signed by the Permanent Head stating that the order was served on the exhibitor is in any legal proceedings for an offence against this section evidence of that fact. ".
