2 Cemetery (Gympie Cemetery) Amendment (No. 1) No. 49, 1994 ˙ Short title 1. This rule may be cited as the Cemetery (Gympie Cemetery) Amendment Rule (No. 1) 1994 . ˙ Amended rules and regulations 2. The rules and regulations made by the trustees of the Gympie Cemetery and published in the Gazette on 23 October 1965 at pages 760-2 are amended as set out in this rule. ˙ Omission of introductory words 3. Introductory words— omit all words from ‘ WHEREAS ’ REGULATIONS ’. to ‘ RULES AND ˙ Replacement of ss.1–2 4. Sections 1 to 2— omit, insert— ˙ ‘Short title ‘1. This rule may be cited as the Cemetery (Gympie Cemetery) Rule 1965 . ˙ ‘Meetings of trustees ‘2.(1) The trustees are to meet on the first Monday of each month at such times and at such place as they agree. ‘(2) The chairperson or 2 trustees may call a special meeting at any time. ’.

Section 5— omit ‘ fees provided for in Schedule A ’, insert ‘ additional fee ’. ˙ Amendment of s.6 6.(1) Section 6— omit ‘ extra fees provided for in such cases (Schedule A) ’, insert ‘ additional fee ’. (2) Section 6— omit ‘ of Schedule B ’, insert ‘ approved by the trustees ’. (3) Section 6— omit ‘ rule ’, insert ‘ section ’. ˙ Amendment of s.7 7.(1) Section 7— omit ‘ memorandum in the form Schedule D ’, insert ‘ notice to the sexton in the form approved by the trustees ’. (2) Section 7— omit ‘ a form, according to Schedule C, ’, insert ‘ an order for preparing grave in the form approved by the trustees ’. ˙ Amendment of s.8 8.(1) Section 8— omit ‘ form Schedule C, and ’, insert ‘ order for preparing grave ’. (2) Section 8— omit ‘ of these regulations ’.

(3) Section 9— omit all words from ‘ If notice ’ to ‘ shall be deemed to be ’, insert ‘ An additional fee is payable if notice is not given. Working hours are ’. (4) Section 9— omit ‘ (forms Schedules C and D) ’. (5) Section 9— omit ‘ the extra fee as provided in Schedule A ’, insert ‘ an additional fee ’. ˙ Amendment of s.10 10. Section 10— omit all words from ‘ All funerals ’, insert— ‘ An additional fee is payable for— (a) a funeral taking place outside the hours fixed; or (b) an interment taking place on a Saturday or Sunday; or (c) a grave (other than a public grave) that is required to be wholly or partly sunk on a Saturday or Sunday. ’. ˙ Amendment of s.11 11. Section 11— omit ‘ (form Schedule B) ’.

(2) Section 14— omit ‘ (form Schedule B), ’. (3) Section 14— omit ‘ according to the scale in Schedule A ’, insert ‘ the fee ’. ˙ Amendment of s.15 13. Section 15— omit ‘ “Cemetery Act, 1865,” or any Act from time to time passed for the amendment thereof or in substitution thereof, ’, insert ‘ Act ’. ˙ Amendment of s.17 14. Section 17— omit all words from ‘ regulations marked ’ to ‘ regulations shall ’, insert ‘ provisions ’. ˙ Replacement of s.19 15. Section 19— omit, insert— ˙ ‘Fees ‘19.(1) The fees payable are the amounts that the trustees consider to be reasonable.
