Cemeteries (Amendment) Regulations 1998
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to make further provision for the depth of burial of corpses in public cemeteries.
2. Authorising provision
These Regulations are made under section 49 of the Cemeteries Act 1958.
3. Multiple burials in sealed graves
At the end of regulation 7 of the Cemeteries
Regulations 19881 insert—"(2) If an exclusive right of burial or interment in
relation to a grave has been exercised at least 1998 and, in the most recent exercise of that right, the grave had been sealed with a stone or concrete slab and the sides of the grave
once before the commencement of the

above the level of the stone or slab had been lined with brick, stone, concrete or a similar material, that right may be exercised to bury or inter another corpse in the grave without complying with regulation 6 if—
(a)
there is at least 300 mm of compacted earth between the coffin and the normal level of the ground or, if a coffin is not used, the corpse and the normal level of the ground; and
(b)
the grave is sealed with a substantial slab of stone, concrete, or similar material as soon as practicable after the burial or interment.".
