An Ordinance to amend the Cemeteries Ordinance 1933

Short title

1.  This Ordinance may be cited as the Cemeteries (Amendment) Ordinance 1987.1

Trustee of cemeteries

2.  Section 6 of the Cemeteries Ordinance 19332 is amended—

(a)by omitting from sub-section (1) all the words from and including “appoint” (first occurring) to and including “less” and substituting—

“appoint as—

(a)trustees of all public cemeteries; or

(b)trustees of a private burial ground,

not less”;

(b)by inserting after sub-section (3) the following sub-sections:

“(3A)  The corporate name of the trustees referred to in paragraph (1) (a) shall be The Trustees of the Canberra Public Cemeteries.

“(3B)  The Minister shall determine the corporate name of the trustees of a private burial ground.”;

(c)by omitting from sub-section (4) “, as determined by the Minister,”;

(d)by inserting in sub-section (6) “public” before “cemetery” (first occurring);

(e)by omitting from sub-section (6) “trustee of that cemetery” and substituting “a trustee referred to in paragraph (1) (a)”;

(f)by inserting in sub-section (7) “public” before “cemetery” (first occurring);

(g)by omitting from sub-section (7) “trustee of the cemetery” and substituting “a trustee referred to in paragraph (1) (a)”;

(h)by inserting in sub-section (8) “public” before “cemetery” (first occurring);

(j)by omitting from sub-section (8) “trustee of that cemetery” and substituting “a trustee referred to in paragraph (1) (a)”; and

(k)by adding at the end the following sub-section:

“(9)  A trustee referred to in paragraph (1) (a) shall, for the purposes of this Ordinance, be taken to be a trustee of each public cemetery.”.
