AN ACT to amend the Cemeteries Act, 1897-1972.

[Assented to 11th May, 1978.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Cemeteries

and citation.

Section 13

amended.

2. Section 13 of the principal Act is amended

(a)

by inserting after the word "and" in line three of subsection (1) the passage ", subject to subsection (la) of this section"; and

(b)

by adding after subsection (1) a new subsection as follows

(la) Notwithstanding the provisions of subsection (1) of this section the trustees of a public cemetery may, with the approval of the Governor, decline to comply with a request made under that subsection.

Section 16

3. Section 16 of the principal Act is amended by

deleting the word "shall" in the penultimate line

and substituting the word "may".

4. Subsection (3) of section 19 of the principal Act is amended by deleting the words ``a fee not exceeding ten cents" in lines two and three and substituting the words "ten cents or other fee prescribed".

Section 21

5. Section 21 of the principal Act is amended by deleting the word "lower" in line seven and in the penultimate line.

Section 22

amended.

6. Subsection (4) of section 22 of the principal Act is amended by deleting the word "lower" in line two.

Section 35

7. Section 35 of the principal Act is amended by

deleting the words "forty dollars" in line eleven and

substituting the words "two hundred dollars".
