Application for approval of the Cement Australia Package Products Operators Coopers Plains Enterprise Agreement 2014.
[1] An application has been made for approval of an enterprise agreement known as the Cement Australia Package Products Operators Coopers Plains Enterprise Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by the Cement Australia Pty Limited. The agreement is a single-enterprise agreement.
[2] I am satisfied that each of the requirements of ss.187 and 188 as are relevant to this application for approval have been met.
[3] My satisfaction as to s.186 is subject to a written undertaking, provided in relation to concerns raised by me in respect of approval of the Agreement, which is attached to this Decision as Annexure A and to the Agreement. In accordance with s.191(1)(b) of the Act the undertaking is taken to be a term of the Agreement.
[4] The Agreement is approved and, in accordance with s.54, will operate from 23 July 2014. The nominal expiry date of the Agreement is 30 May 2018.
