Application for approval of the Cedar Creek Constructions Pty Ltd Enterprise Agreement 2020 - 2024.

[1] An application has been made for approval of an enterprise agreement known as the Cedar Creek Constructions Pty Ltd Enterprise Agreement 2020 - 2024 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Cedar Creek Constructions Pty Ltd. The Agreement is a single enterprise agreement.

[2] On 1 September 2020 the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU) contacted the Commission and requested that it be provided with documentation in relation to the Agreement. In accordance with its usual practice the Commission did so on 4 September 2020. On 11 September 2020, my Chambers emailed the CFMMEU indicating that I was inclined to approve the Agreement. On 15 September 2020, the CFMMEU advised that it no longer wished to be heard in relation to the approval of the Agreement.

[3] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 23 September 2020. The nominal expiry date of the Agreement is 22 September 2024.
