1 THE COURT: I do not wish to say too much in view of the fact litigation has not finished, but I think it is sufficient for present purposes to say that on this interlocutory application we are unable to detect any error in the reasons of his Honour, the trial judge.

2 For those reasons the order of the Court will be, the summons is dismissed with costs.
