AN ORDINANCE further to amend the Laws relating to

Trespasses by Live Stock.

[ 15th July, 1867. ]

HERE AS it is expedient to afford additional protection to

Lessees of Crown Lands with respect to trespasses on un-

fenced lands purchased within the boundaries of their leases; Be it

therefore enacted by His Excellency the Governor of Western Aus-

tralia and its Dependencies, by and with the advice and consent of

the Legislative Council thereof, as follows:-

Ordinance to amend an Ordinance to consolidate and amend the Law repealed.

relating to Trespasses by live stock and to promote. the construction of

fences, is hereby repealed.

ANY purchaser from the Crown of land situate. within the Purchaser of lands bought

thereon, or to recover dam- and his assigns, shall not recover any damage, penalty, pound- ages, &c., unless his lands age, fees, or expenses arisin g out of a trespass thereon by live stockare fenced.

belonging to or in the care of the then existing or any future lessee or occupant of such leased Crown . land, nor shall it be lawful for such purchaser, or his assigns, to; impound such live stock so tres- passing, unless such first mentioned land, or the part thereof tres- passed on, shall at the time of such trespass be enclosed by a sub- stantial fence reasonably deemed sufficient to resist the trespass of great and small stock including sheep, but not including goats or pigs.
