CATTLE SLAUGHTERING AND DISEASED ANIMALS AND MEAT (AMENDMENT) ACT.

Act No. 8, 1947.

An Act to amend the Cattle Slaughtering and Diseased Animals and Meat Act, 1902, and certain other Acts in certain respects; and for purposes connected therewith. [Assented to, 28th March, 1947.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with, the advice and consent of the Legis- Wales in Parliament assembled, and by the authority of
the same, as follows :—

1 . (1) This Act may be cited as the "Cat t l e Slaughtering and Diseased Animals and Meat (Amend- ment) Act, 1947."

(2) The Cattle Slaughtering and Diseased Animals and Meat Act, 1902, as amended by subsequent Acts, is in this Act referred to as the Principal Act.

(3) The Cattle Slaughtering and Diseased Animals
and Meat Act, 1902, as amended by subsequent Acts and
by this Act, may be cited as the Cattle Slaughtering and
Diseased Animals and Meat Act, 1902-1947.

2 .     The Pr inc ipa l Act is amended—

(a) (i) by omitting subsection one of section four;

(ii)   by inserting in subsection two of the same section af ter the word " m a y " the words

" w i t h the approva l of the M i n i s t e r " ;

(b) by omit t ing subsection seven of section fifteen;

(c) by omitting from section eighteen the definition
of " T h e B o a r d " ;
(d) by omitting from section twenty the words " P r o v i d e d tha t dur ing the t ime tha t an abat toir , established by a council or councils of any municipal i ty or municipali t ies unde r the provis ions of this Division, is used as a public s laughter-house, the Boa rd shall be the local au thor i ty within the distr ict or dis t r ic ts included
in the said municipal i ty or mun ic ipa l i t i e s " ;
(e )
(i) by omit t ing from p a r a g r a p h (c) of sub­

section one of section twenty-one the words " t h e Boa rd and its officers" and by inser t ­ ing in lieu thereof the words " a n y person author ised in tha t behalf by the M i n i s t e r " ;

(ii) by omit t ing from the same p a r a g r a p h the
words " B o a r d may r e q u i r e " and by insert­
ing in lieu thereof the words " M i n i s t e r m a y
r e q u i r e ' ' ;
(iii) by omit t ing from p a r a g r a p h (e) of the same
subsection the word " B o a r d " and by
inser t ing in lieu thereof the word
" M i n i s t e r " ;

(f) (i) by omit t ing the heading to section twenty-

three ;

(ii)

(ii)   by omitting subsection one of the same section and by inser t ing in lieu thereof the following subsection:—

(1) Any person author ised by the Min­ is ter in tha t behalf, may, a t any time, exercise the r igh t of en t ry and inspection conferred on a local au thor i ty by sections twenty-one and twenty-two of this Act.

(iii) by omit t ing from subsection two of the

same section the word " B o a r d " wherever occurr ing and by inser t ing in lieu thereof

the word " M i n i s t e r " ;
(g) by omitting from section twenty-four the word
" B o a r d " wherever occurr ing and by inser t ing
in lieu thereof the word " M i n i s t e r " ;
(h) by omitting from section twenty-six the words and symbols " (not being an aba t to i r established
under the au thor i ty of this A c t ) " ;

(i)   by omitting section twenty-seven and the heading t he r e to ;

(J) by omit t ing from subsection one of section

twenty-nine the words " u p o n the recommenda­

tion of the B o a r d " ;
(k) by omitting from section thirty-one the word
" B o a r d " and by inser t ing in lieu thereof the
word " M i n i s t e r " ;

(1) by omit t ing from section forty-six the definition

of " B o a r d " ;

(m) (i) by omit t ing from subsection one of section

fifty the words " A n y officer of, or person author ised by the B o a r d " and by inser t ing in lieu thereof the words " A n y person author ised in t ha t behalf by the M i n i s t e r " ;

(ii)

by omitting from subsection three of the same section the words "officer or inspec­ t o r " and by inser t ing in lieu thereof the

words " a u t h o r i s e d p e r s o n " ;
(n) by omit t ing from section fifty-one the words
"officer o r " ;

(o)

(o) (i) by omitting from section fifty-four the

words "officer or person" and by inserting

in lieu thereof the word " p e r s o n " ;

(ii)   by omitting from the same section the words "officer or any assistant" and by inserting in lieu thereof the words "person or any assis tant";

(p) by omitting from section fifty-five the words "officer o r " wherever occurring;
(q) by omitting from subsection one of section fifty- six the words "on the recommendation of the Board" ;
(r) by omitting from subsection one of section fifty- seven the words "on the recommendation of the Board" wherever occurring.

3 . All persons appointed under subsection two of section four of the Principal Act and holding office at the commencement of this Act shall be deemed to have been appointed under the provisions of that subsection as amended by this Act.
