I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Cattle Slaughter Levy Collection Act 1960.

CATTLE SLAUGHTER LEVY COLLECTION REGULATIONS.

Citation.

1. These Regulations may be cited as the Cattle Slaughter Levy Collection Regulations.

Commencement.

2. These Regulations shall come into operation on the first day of July, 1960.

Interpretation.

3.(1.) In these Regulations, unless the contrary intention appears—

“authorized agent” means a person appointed in pursuance of regulation 6 of these Regulations to be an authorized agent;

“return” means a return required to be furnished in pursuance of sub-regulation (1.) of regulation 5 of these Regulations;

“Territory” means Territory of the Commonwealth;

“the Act” means the Cattle Slaughter Levy Collection Act 1960.

(2.) In these Regulations—

(a) a reference to a Schedule by number shall be read as a reference to the Schedule so numbered to these Regulations; and

(b)a reference to a form by number shall be read as a reference to the form so numbered in the Second Schedule.

Manner of payment of levy, &c.

4. The payment of levy and other amounts payable to the Commonwealth under the Act with respect to cattle slaughtered at an abattoir in a State or Territory shall be made to the Collector of Public Moneys, Department of Primary Industry at the place the name of which is specified in column 2 of the table in the First Schedule opposite to the name of the State or Territory in column 1 of that table.

Returns.

5.—(1.) The proprietor of an abattoir at which cattle are slaughtered during a month shall, within twenty-eight days after the last day of that month, furnish to the Secretary to the Department of Primary Industry a return with respect to the cattle so slaughtered at that abattoir.

(2.) A return with respect to cattle slaughtered at an abattoir in a State or Territory shall be lodged with the Collector of Public Moneys, Department of Primary Industry at the place the name of which is specified in column 2 of the table in the First Schedule opposite to the name of the State or Territory in column 1 of that table.

(3.) A return shall be in accordance with Form 1.

Authorized agents.

6.—(1.) The proprietor of an abattoir may appoint a person to be his authorized agent for the purpose of executing on behalf of the proprietor the declaration set out in Form 1.

(2.) The appointment of an authorized agent by the proprietor of an abattoir in a State or Territory—

(a) shall be in accordance with Form 2; and

(b) shall be lodged with the Collector of Public Moneys, Department of Primary Industry at the place the name of which is specified in column 2 of the table in the Second Schedule opposite to the name of the State or Territory in column 1 of that table.

Proper records to be kept.

7. The proprietor of an abattoir at which cattle are slaughtered, or a person who causes cattle to be slaughtered at an abattoir of which another person is the proprietor, shall keep proper records showing, with respect to the carcases of the cattle so slaughtered at the abattoir or so caused to be slaughtered by him, as the case may be, during each month—

(a) the number of those carcases (not being carcases referred to in paragraph (c) of this regulation) the dressed weight of which exceeded—

(i) in the case of a carcase having the skin removed—two hundred pounds; and

(ii) in the case of a carcase having the skin on—two hundred and twenty pounds;

(b) the number of those carcases (not being carcases referred to in paragraph (c) of this regulation) the dressed weight of which did not exceed—

(i) in the case of a carcase having the skin removed—two hundred pounds; and

(ii) in the case of a carcase having the skin on—two hundred and twenty pounds; and

(c) the number of those carcases that could not lawfully be used for human consumption by reason of their having been condemned or rejected by an inspector in pursuance of a law of the Commonwealth or of a State or Territory.

Penalty: One hundred pounds.

Statement to be furnished at request of the proprietor.

8. A person who, during a month, causes cattle to be slaughtered at an abattoir of which another person is the proprietor shall, when requested so to do by the proprietor, furnish to the proprietor a statement setting out the information required to be recorded by the person under the last preceding regulation with respect to the carcases of the cattle so slaughtered.
