No. XI.

An Act to regulate the importation of Cattle for the purpose of prevent ing the introduction of Contagious or Infectious Disorders and to prevent the propagation thereof in the Colony.

WH E R E A S p ropaga t ion in t he Colony of p leuro-pneumonia or o ther disease
it is expedient to check t h e in t roduc t ion in to or

a m o n g horned Cat t le Be it therefore enacted by t h e Queen ' s Mos t Exce l len t Majesty by and with the advice and consent of t h e Legisla­ t ive Counci l a n d Legislat ive Assembly of N e w South Wales in Par l ia­ m e n t assembled and by the au tho r i t y of t h e same as follows :—

1 . I t shall be lawful for t h e Governor w i th t he advice of t he

Execut ive Counci l by P roc lamat ion to p roh ib i t t h e impor ta t ion or in t roduct ion into t he Colony or in to any por t thereof from any specified place and for any specified t ime of any horned Cat t le and to au thor ize t h e des t ruc t ion of any such Cat t le as m a y be in t roduced con t r a ry to to such prohibi t ion.

2. I t shall also be lawful for t he Governor wi th t h e l ike advice

by l ike P roc lama t ion to m a k e such regula t ions respect ing any ho rned

Cat t le as m a y be deemed necessary for p reven t ing t he in t roduc t ion or propagat ion of any contagious or infectious disorder whe the r by sub­ mi t t i ng such Cat t le to any specified system of qua ran t ine or by t h e des t ruct ion of any such Cat t le found or suspected to be infected or of any hay s t raw fodder or o ther art icle whereby the re m a y be danger of any infection or contagion being in t roduced or p ropaga ted .

3 . Every such Proc lamat ion as aforesaid shall w i th in fourteen

days after t h e da te thereof be twice publ i shed in t he Gazette and shal l upon such second publ ica t ion b u t not sooner have t h e full force of law A n d every such Proc lamat ion shall be laid before both Houses of Pa r l i amen t for thwith if t h e n s i t t ing and if n o t wi th in four teen days

after t h e commencement of t h e t h e n nex t Session.
4. Al l horned Cat t le impor ted or in t roduced in to t h e Colony
con t ra ry to any such Proc lamat ion or to any regula t ion established
thereby or t he r eunde r m a y b e seized and shall be forfeited in l ike m a n n e r

as any con t raband goods l iable to be seized a n d forfeited unde r any law re la t ing to t h e Customs A n d every person concerned in impor t i ng or i n t roduc ing or a t t e m p t i n g to impor t or in t roduce any Cat t le in violat ion of a n y such Proc lamat ion or regula t ion shall for every such offence u p o n convict ion thereof be liable to a fine no t exceeding fifty pounds and n o t less t h a n t e n pounds to be recovered by a n y person su ing for t h e same before two or more Jus t ices of t he Peace in a

s u m m a r y m a n n e r .

5. This A c t shall cont inue in force for t he period of two years

from t h e da te of t he pass ing thereof and shall be styled and m a y be

cited as t h e " Cat t le Disease Prevent ion Ac t of 1 8 6 1 . "
