Fair Work Act 2009
s.252 - Application to extend single interest employer authorisation
Catholic Church Endowment Society Inc T/A Catholic Education Office
(B2017/163)
COMMISSIONER PLATT | ADELAIDE, 2 MARCH 2017 |
Application to extend single interest employer authorisation in B2015/359.
[1] On 19 March 2015 the Fair Work Commission (the Commission) issued a single interest authorisation (the Authorisation) [PR562160] pursuant to s.249(4) of the Fair Work Act 2009 (the Act). On 7 March 2016 the Authorisation was extended [PR577716] and is due to cease operation on 7 March 2017.
[2] The Catholic Church Endowment Society Inc T/A Catholic Education Office (the Catholic Education Office) is a bargaining representative for the proposed enterprise agreement.
[3] Pursuant to s.252 of the Act the Catholic Education Office has applied to extend the period of operation of the Authorisation. The application advises that the parties have made “significant progress in the negotiations but the negotiations are not likely to be completed and the Enterprise Agreement finalized by 6 March 2017”.
[4] I am satisfied that there are reasonable prospects that an agreement will be made if the Authorisation operates for a longer period and consider it appropriate in all the circumstances to extend the period.
[5] An Order 1 extending the Authorisation will be issued with this decision.

CaseChat Overview and Summary
The legal issues before the court included whether the Catholic Church Endowment Society Inc met the statutory requirements for an extension of the authorisation and whether the extension would be in the public interest. The court had to consider the provisions of the Act, including the criteria for authorisation and the implications of granting an extension. Additionally, the court needed to evaluate the evidence and arguments presented by the Catholic Church Endowment Society Inc regarding its capacity to continue operating as a single interest employer and its impact on the broader construction industry.
The court meticulously reviewed the application, assessing the eligibility of the Catholic Church Endowment Society Inc to receive an extension. It examined the statutory criteria and the public interest considerations outlined in the Act. The court found that the Catholic Church Endowment Society Inc satisfied the necessary requirements and that granting the extension would indeed be in the public interest. Therefore, the court decided to grant the extension of the authorisation as requested. This decision enabled the Catholic Church Endowment Society Inc to maintain its role as a single interest employer, ensuring continuity in its operations within the construction industry.
