An Act to amend an Act inti tuled "An Act to
"authorize the appropriation of the Old
"Burial Ground or Cathedral Close in "Sydney to certain municipal and other
"public purposes." [5th December, 1870.]
| WH E R E A S by an Ac t passed in the thir ty-second year of the | reign of H e r present Majesty int i tuled "An Act to authorize | the |

" to certain municipal and other public purposes'" it is enacted among other th ings t h a t i t shall no t be lawful for the Munic ipa l Council of Sydney or the Bishop of Sydney or any of his successors to erect any dwell ing-house residence or other bui lding on any port ion of the land described in ei ther the first or second Schedule to the said A c t except on t he half acre granted as the site for a Town H a l l and if any such dwelling-house residence or building should be erected thereon contrary to the provisions of the said A c t the par ty or parties so offend ing shall be subject to a penal ty of one thousand pounds and any colonist may th rough the Supreme Court sue for and shall be enti t led to the said penal ty and the land described in t he Schedule on which such bui lding may be erected shall revert to t he Crown A n d whereas it is deemed expedient to extend the exception contained in t he th i rd section of t he said A c t so as to allow the Bishop of Sydney or his successors to erect on the western port ion of the land described in t he second Schedule to the said Ac t a suitable dwelling-house and buildings for the residence of the chief officiating Minis ter of the said Cathedral Be i t therefore enac ted by the Queen ' s Most Exce l l en t Majesty by and wi th t he advice and consent of the Legislat ive Council and Legislat ive Assembly of New South Wales in Pa r l i amen t assembled and by the au thor i ty of the same as follows :—
| in t he said th i rd section thereof contained i t shall be lawful for the Bishop of Sydney or his successors to erect on t he land described in the Schedule hereto being the westerly pa r t of the said land described in t he second Schedule to the said Act a suitable dwelling-house and buildings connected therewith for the residence of the chief officiating Minis ter of the said Cathedral A n d this Act and the said Ac t shall be read together as if t he exception contained in the said th i rd section of t he said A c t had extended to the erection of the said dwelling-house and buildings hereinbefore mentioned. | S C H E D U L E . |

All t ha t parcel of land commencing on the east building a l ignment of Clarence- s t ree t a t t h e nor th-west corner of t he Cathedra l g ran t and bounded on the south by t h e said Cathedra l g ran t for one h u n d r e d feet and thence on the east by a l ine bear ing north th ree degrees west to t he land contained in t he first Schedule to the said Ac t and thence on the no r th by the said land to Clarence-street and thence by the said s t reet to t he point of commencement.
