Cat Amendment Regulations (No. 2) 2013
Made by the Governor in Executive Council.
1. Citation
These regulations are the Cat Amendment Regulations
(No. 2) 2013.2. Commencement
These regulations come into operation as follows —
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette (gazettal day);
(b) regulation 5 — on the day the Cat Regulations 2012 regulation 10 comes into operation;
(c) the rest of the regulations — on the day after gazettal day.
3. Regulations amended
These regulations amend the Cat Regulations 2012.
4. Regulation 5 amended
In regulation 5(1):
(a) in paragraph (a) delete “scheme, published 29 June 2001;” and insert: scheme, as amended from time to time;
(b) in paragraph (b) delete “methods, published 7 June 2001.” and insert: methods, as amended from time to time.
5. Regulation 10 amended
(1) At the beginning of regulation 10 insert:
(1) In this regulation — exhibited means exhibited for show purposes at a cat
show held by —
(a) the Cat Owners’ Association of Western Australia; or

(b)
the Feline Control Council of Western Australia; or
(c) Australian National Cats Inc.; or (d)
a body that is affiliated with a body mentioned in paragraph (a), (b) or (c).
(2) In regulation 10 delete “The owner” and insert: (2) The owner 6. Regulation 11 amended
(1) Delete regulation 11(1) and insert:
(1) An application for the grant or renewal of the registration of a cat under section 8 of the Act must —
(a)
be made by supplying the details required in Form 1 Parts A, B, D, F and G to the local government; and
(b)
be accompanied by the application fee payable under Schedule 3.
(2) In regulation 11(2) after “required” insert: under subregulation (1)(a)
Note: The heading to amended regulation 11 should read: Application for registration (s. 8(2))
7. Regulation 12 amended
Delete regulation 12(2) and insert:
(2) Registration of a cat —
(a) has effect from the period specified in the registration certificate until —
(i) in the case of registration for one
year — the next 31 October, unless
cancelled sooner; or
(ii) in the case of registration for 3 years —
31 October in the final year of that period, unless cancelled sooner; or
(iii) in the case of registration for the life of
the cat — the death of the cat, unless
cancelled sooner;

and
(b) may be renewed to take effect as from period of 21 days.
8. Regulation 21 replaced
Delete regulation 21 and insert:
21. Application for approval to breed cats (s. 36(2))
An application for the grant or renewal of approval to
breed cats under section 36 of the Act must —
(a) be made by supplying the details required in Form 1 Parts A, B, E, F and G to the local government; and (b) be accompanied by the application fee payable under Schedule 3.
9. Schedule 3 inserted
After Schedule 2 insert:
Schedule 3 — Fees
[r. 11 and 21]
1. Fees payable
(1) In this clause — pensioner means an eligible pensioner as defined in the Rates and Charges (Rebates and Deferments) Act 1992 section 3(1). (2) The fees specified in the Table are payable for the matters
set out in the Table.(3) Despite subclause (2), if the owner of a cat is a pensioner,
the fee payable for an application for the grant or renewal of
the registration of the cat is 50% of the fee that would
otherwise be payable under subclause (2).
