Cat Amendment Regulations 2016

Made by the Governor in Executive Council.

1.           Citation

11 March 2016 GOVERNMENT GAZETTE, WA 687

2.            Commencement

These regulations come into operation as follows -

(a) regulations 1 and 2—on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations - on the day after that day.

3.            Regulations amended

These regulations amend the Cat Regulations 2012.

4.            Regulation 9 amended

Delete regulation 9(c) and insert:

(c) the Department of Immigration and Border

Protection of the Commonwealth;

5.            Schedule 1 amended

Delete Schedule 1 Form 5 and insert:

Form 5—Warrant to enter, search and seize

THIS IS A WARRANT authorising an authorised person under the
Cat Act 2011 to enter and search -

I, a justice of the peace, am satisfied, by an application supported by evidence on oath, that -

CI there are reasonable grounds for suspecting that there is, at the

place something that may afford evidence of the commission of

an offence under the Cat Act 2011;

OR

0 entry onto the place is reasonably required to investigate a

suspected offence against the Cat Act 2011;

OR

0 there are reasonable grounds for suspecting that an offence under the Cat Act 2011 is likely to be committed in respect of the cat if it is not seized.

I authorise , an authorised person under Part 4 Division 3 of the Cat Act 2011, to exercise the entry, search and seizure powers set out in that Act in relation to the premises set out in this warrant, with such assistance, and using such force, as is reasonably necessary during the time referred to in this warrant.
