Casino Control Amendment Regulation (No. 1) 2009 [s 1] 1 Short title This regulation may be cited as the Casino Control Amendment Regulation (No. 1) 2009 . 2 Commencement This regulation commences on 1 July 2009. 3 Regulation amended This regulation amends the Casino Control Regulation 1999. 4 Amendment of s 10 (Requirements of entities) Section 10(2), definition related body corporate ‘Law’— omit, insert— ‘Act, section 9’. 5 Amendment of s 18 (List of licensees—Act s 42) Section 18, heading, ‘Act’— omit, insert— ‘ Act, ’. 6 Replacement of pt 4 (Fees, taxes and levies) Part 4— omit, insert— Page 2 2009 SL No. 121

‘Part 4 Casino Control Amendment Regulation (No. 1) 2009 [s 6] Casino tax, community investment fund and Casino Community Benefit Fund ‘19 Percentage determined for casino gross revenue—Act, s 51(4) ‘(1) For the Act, section 51(4), the percentage determined for casino gross revenue for an associated agreement for a casino licence is— (a) for the casino licence relating to the agreement made under the Brisbane Casino Agreement Act 1992 — (i) for gaming machine revenue—30%; or (ii) for other revenue—20%; or (b) for the casino licence relating to the agreement made under the Jupiters Casino Agreement Act 1983 — (i) for gaming machine revenue—30%; or (ii) for other revenue—20%; or (c) for the casino licence relating to the agreement made under the BreakwaterIslandCasinoAgreementAct1984 — (i) for gaming machine revenue—20%; or (ii) for other revenue—10%; or (d) for the casino licence relating to the agreement made under the Cairns Casino Agreement Act 1993 — (i) for gaming machine revenue—20%; or (ii) for other revenue—10%. ‘(2) In this section— gaming machine revenue means the part of casino gross revenue derived from the operation of gaming machines. other revenue means casino gross revenue other than gaming machine revenue. 2009 SL No. 121 Page 3

Casino Control Amendment Regulation (No. 1) 2009 [s 7] ‘19A Percentage determined for premium junket revenue—Act, s 51(4) ‘For the Act, section 51(4), the percentage determined for premium junket revenue for an associated agreement for a casino licence is 10%. ‘19B Percentage for community investment fund—Act, s 51A(3) ‘For the Act, section 51A(3), the percentage is 8.5%. ‘19C Casino Community Benefit Fund—Act, s 52(8) ‘For the Act, section 52(8), a single trust deed may apply to the amounts apportioned under the Act, section 52(4) for the following casino licences— (a) the casino licence relating to the agreement made under the Brisbane Casino Agreement Act 1992 ; (b) the casino licence relating to the agreement made under the Jupiters Casino Agreement Act 1983 .’. 7 Amendment of s 43A (Prescribed persons for appointment as inspectors—Act, s 6) (1) Section 43A, heading, ‘6’— omit, insert— ‘ 85E( 2) ( a) ( ii) ’.
