CASINO CONTROL ACT 1992—REGULATION
(Relating to payment of liquor licence fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Casino Control Act 1992, has been pleased to make the Regulation set forth hereunder.

Part B of Schedule 4 (Application of Liquor Act 1982 to the casino) to
the Casino Control Regulation 1995 is amended:
(a)
by omitting from section 80 the word “subclause” wherever occurring and by inserting instead the word “subsection”;
(b)
by inserting after section 80 (4) (b) the following word and paragraph:

(c)
must be paid by 6 instalments calculated in accordance with subsection (6), the first instalment being payable before the commencement of the licensing period and the remaining instalments being payable on or before 15 February, 15 March, 15 April, 15 May and 15 June in the year in which the licensing period commences.
(c) by inserting after section 80 (5) the following subsections:
(6) If a licence fee is paid as provided by subsection (4) (c):
(a) the amount of each of the first 5 instalments is:(i) if the licence fee is a multiple of 6 dollars—one
sixth of the licence fee; or

(ii) if the licence fee is not a multiple of 6 dollars—an
amount that would be one sixth of the licence fee if the licence fee were increased by the amount necessary (of less than 6 dollars) to make the licence fee a multiple of 6 dollars; and
(b) the amount of the last instalment is the balance of the licence fee after payment of the first 5 instalments. (7) The method of payment of a licence fee referred to in subsection (4) (c) (that is, payment by 6 instalments) is only available in respect of a licence fee for a licensing period that commences on or after 16 January 1996.
EXPLANATORY NOTE
At present the liquor licence fee for the casino must be paid before the licensing period commences (16 January in each year) or be paid in 2 instalments (the first being payable before the licensing period commences and the second being payable within 4 months after that commencement). The object of this Regulation is to add the option of paying the fee in 6 equal (or approximately equal) instalments, payable on or before the 15th of January, February, March, April, May and June. As a result, the payment options mirror the options available for the payment of liquor licence fees under the Liquor Act 1982.
This Regulation is made under the Casino Control Act 1992, including section 170
(the general regulation making power) and section 89 (Application of Liquor Act 1982).
