CASA EX98/21 — ATPL Flight Test Standards (Satellite-based Navigation) Exemption 2021

1          Name

                 This instrument is CASA EX98/21 — ATPL Flight Test Standards (Satellite‑based Navigation) Exemption 2021.

2          Duration

                 This instrument:

(a)   commences on the day after it is registered; and

(b)   is repealed at the end of 29 February 2024.

3          Definitions

        (1)     In this instrument:

air transport pilot licence has the same meaning as in Subpart 61.K of CASR.

associated (in relation to when an aircraft category rating is associated with a pilot licence) has the meaning given by regulation 61.010 of CASR.

ATPL(A)meansair transport pilot licence with the aeroplane category rating.

exemptions means the exemptions set out in section 5.

flight examiner has the meaning given by regulation 61.010 of CASR.

flight test has the meaning given by regulation 61.010 of CASR.

Part 61 MOS means the Part 61 Manual of Standards.

        (2)     A person is an exempted pilot if:

(a)   the person is an applicant for an ATPL(A); and

(b)   holds a valid instrument proficiency check for their aeroplane category rating in accordance with regulation 61.880 of CASR.

4          Application of exemptions

   (1)     The exemptions apply only in relation to a flight test for the grant of an ATPL(A) for which the following 3 flight simulation training devices (FSTDs) may be used for flight testing in accordance with Appendix K.1 of Schedule 5 to the Part 61 MOS:

(a)   Beechcraft King Air 200 (AUS No. 42 Serial No. 8315);

(b)   Embraer 120 Brasilia (AUS No. 45 Serial No. 8337);

(c)   Fairchild Metro III (AUS No. 18 Serial No. 8321).

        (2)     The exemptions only apply to flight testing for the grant of an ATPL(A) conducted in the specified FSTDs, being flight testing referred to in paragraphs 3.3 (a) and (b) of Appendix K.1 of Schedule 5 (paragraphs 3.3 (a) and (b)) that is required:

(a)   to ensure competency in the use of satellite-based navigation systems to navigate en route; and

(b)   to perform integrity checks for those systems.

        (3)     The exemptions apply in relation to an exempted pilot, and a flight examiner, to the extent set out in section 5.

5          Exemptions

        (1)     An exempted pilot is exempt from compliance with paragraph 61.700 (3) (c) of CASR in relation to the competencies required to be demonstrated under paragraphs 3.3 (a) and (b) in relation to the use of satellite-based navigation systems, as referred to in subsection 4 (2).

        (2)     Aflightexaminer,whoconductsaflighttestmentionedin paragraph 61.700(3)(c) of CASR for an exempted pilot, and the exempted pilot are exempt from compliance with regulation 61.250 of CASR to the extent that the regulation requires the examiner to assess the pilot’s performance as meeting the competency standards mentioned in the Part 61 MOS that relate to the flight testing required under paragraphs 3.3 (a) and (b) as referred to in subsection 4 (2).

        (3)     Aflightexaminerwhoconductsaflighttestmentionedinparagraph61.700(3)(c)ofCASRforanexemptedpilotisexemptfromcompliancewithparagraph61.1295(3)(b)ofCASRtotheextentthatthepilotwouldotherwiseberequired to demonstrate their ability:

(a)   to ensure competency in the use of satellite-based navigation systems to navigate en route; and

(b)   to perform integrity checks for those systems.
