Exemption – Civil Aviation Order 48.1 Instrument 2013 – aerial application operations (in aeroplanes)
1 Commencement
This instrument:
(a) commences on the day after registration; and
(b) is repealed at the end of 31 May 2019.
2 Definition
In this instrument:
aerial application operation has the meaning given by regulation 137.010 of CASR 1998 as in force from time to time.
3 Application
This instrument applies to the following persons:
(a) an Air Operator Certificate holder engaged in an aerial application operation (the operator);
(b) each flight crew member (FCM) of a person mentioned in paragraph (a).
Note This instrument, therefore, applies to operators and FCMs conducting operations under Part 137 of CASR 1998.
4 Exemptions
(1) The persons mentioned in section 3 are exempt from compliance with the requirements of Civil Aviation Order 48.1 Instrument 2013 as in force from time to time.
(2) The persons mentioned in section 3 are exempt from compliance with the requirements of Civil Aviation Amendment Order (No. R48) 2004 as in force from time to time.
5Condition
From 1 May 2017, the exemptions mentioned in section 4 are subject to the condition mentioned in Schedule 1.
Schedule 1 Condition
Before any FCM conducts an aerial application operation for the operator, the operator must be satisfied that the FCM has received awareness material, or training, in managing the fatigue-related risks relevant to his or her duties as an FCM.
Note A person will also be required to comply with the requirements of Subpart 137.Q of CASR 1998 if those requirements apply to the person.
