Exemption — flight data recording

1          Duration

            This instrument:

(a)   commences on 25 December 2008; and

(b)   stops having effect at the end of December 2009.

2          Application

            This instrument applies to the aircraft mentioned in Schedule 1 (the aircraft) and operated by State of Queensland, acting through Queensland Government Air Wing, Aviation Reference Number 225248 (the operator), and used in private operations.

3          Exemption

The aircraft is exempt from compliance with subregulations 21A (1) and 207 (2) of CAR 1988 only to the extent mentioned in Schedule 2.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 3 which are necessary in the interests of safety.

Schedule 2          Extent of exemption

             The exemption extends only to:

(a) the standards under subregulation 21A (1) of CAR 1988 contained in Appendix 1 of Civil Aviation Order 103.19 in relation to recording intervals; and

(b) the directions under subregulation 207 (2) of CAR 1988 contained in paragraph 6.2 of Civil Aviation Order 20.18.

Schedule 3          Conditions

      1     The aircraft must be equipped with a serviceable cockpit voice recorder.

      2     The aircraft must be equipped with a serviceable flight data recorder.

      3       A copy of the instrument must be carried on board the aircraft.

      4     A copy of the instrument must be kept in the permanent records of the aircraft.
