Exemption — use of ADS-C separation minima

1           Duration

                This instrument:

(a)     commences on the day after it is registered; and

(b)     stops having effect at the end of 30 September 2011.

2           Application

                This instrument applies to Airservices Australia (AA) when using Automatic Dependent Surveillance-Contract (ADS-C) in determining longitudinal distance separation.

3           Exemption

                AA is exempt from compliance with subregulation 172.065 (1) of CASR 1998 to the extent mentioned in Schedule 1.

Note   Paragraph 10.6.10.2 (b) of the Manual of Standards Part 172 — Air Traffic Services (the MOS) states that the method of determining longitudinal distance separation using ADS-C when both aircraft are within CTA is a comparison of the actual ADS-C report symbol of an FANS‑1/A aircraft with the position of another aircraft determined by an alternative form of position fixing, such as radar, ADS-B, voice or CPDLC reports.

4           Conditions

                The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1             Extent of Exemption

                The exemption extends only to the requirement to comply with paragraph 10.6.10.2 (b) of the MOS.

Schedule 2             Conditions

                AA must use a comparison of the actual ADS-C report symbol of an FANS-1/A aircraft with the position of another aircraft determined by an alternative form of position fixing, such as radar, ADS-B, voice or CPDLC reports.
