Exemption — instrument rating flight tests for navigation aid endorsements

1          Duration

                 This instrument:

(a)   commences on the day after registration; and

(b)   stops having effect at the end of April 2013.

2          Definitions

                 In this exemption:

ILS, NDB and VOR have the same meanings as in Civil Aviation Order (CAO) 40.2.1.

3          Application

                 This instrument applies to a person undertaking an instrument rating flight test for the issue of an ILS, NDB or VOR navigation aid endorsement (the applicant).

4          Exemptions

        (1)     The applicant is exempt from paragraphs 5.14 (2) (a) and 5.14 (3) (b) of the Civil Aviation Regulations 1988 to the extent set out in Schedule 1.

        (2)     Clauses 1 and 4 of Schedule 1 apply subject to the conditions set out in Schedule 2 for the use of a synthetic flight training device (SFTD).

Schedule 1          Extent of exemption

        1     In spite of the requirements of subparagraph 2.1 (d) of Appendix I to CAO 40.2.1, an applicant may, for the initial endorsement of the VOR navigation aid on an instrument rating, use an SFTD to demonstrate proficiency in sector entry and holding procedures.

        2     In spite of the requirements of subparagraph 2.1 (d) of Appendix I to CAO 40.2.1, an applicant may, for the initial endorsement or renewal of the ILS navigation aid on an instrument rating, demonstrate competence in the use of the navigation aid:

(a)   by being vectored onto the localizer by ATC or by intercepting the localizer by using a DME arc procedure; and

(b)   without demonstrating an ILS holding pattern.

        3                 In spite of the requirements of subparagraphs 3.5 (a) and (b) of Appendix I to CAO 40.2.1, if a descent is specified on the outbound leg of an NDB or VOR procedure, the applicant, for initial issue or renewal, may commence the descent to the required altitude without achieving the required tolerance of +/- 5o of nominated track, if the descent is carried out in accordance with the operational procedures mentioned in AIP or in ATC instructions.

        4     In spite of the requirements of Appendix II to CAO 40.2.1, an applicant for the initial endorsement of the VOR navigation aid on an instrument rating may demonstrate proficiency in sector entry and holding procedures in an SFTD.

Schedule 2          Conditions

        1                 Clauses 1 and 4 of Schedule 1 apply only if:

(a)   the ATO conducting the flight test is authorised to do so by a current delegation; and

(b)   the SFTD is an SFTD referred to in clause 2.

        2     If the SFTD has a current approval issued under CAO 45.0 as a Category B or C synthetic trainer, it is taken to be approved under paragraph 9.2 of CAO 40.2.1 for the conduct of flight tests referred to in clauses 1 and 4 of Schedule 1.

        3     Clause 2 applies to an SFTD in spite of any condition to the contrary that may be contained in its current approval under CAO 45.0.
