Exemption – Civil Aviation Order 100.7 – requirement for aircraft to be weighed on scales calibrated by an accredited laboratory

1          Duration

                 This instrument:

(a)   commences on 1 July 2017; and

(b)   is repealed at the end of 30 June 2018.

2          Definitions

                 In this instrument:

accredited organisation, in relation to a reference standard, means an organisation holding an accreditation to calibrate the reference standard issued by:

(a)   the National Association of Testing Authorities Australia; or

(b)   an entity that is a full member of International Laboratory Accreditation Cooperation.

CAO 100.7 aircraft means an aircraft to which Civil Aviation Order 100.7 applies, as the Order is in force from time to time.

responsible person means a person with responsibility for the weighing of a CAO 100.7 aircraft who:

(a)   is a WCO; or

(b)   meets the requirements mentioned in paragraph 4.1A of Civil Aviation Order 100.7.

weight control officer or WCO has the same meaning as in section 2 of Civil Aviation Order 100.7 as in force from time to time.

3          Exemption

        (1)     For regulation 11.160 of CASR, a responsible person is exempt from compliance with paragraph 4.3 of Civil Aviation Order 100.7 in respect of a CAO 100.7 aircraft.

Note   Paragraph 4.3 of Civil Aviation Order 100.7 requires that each scale used to weigh CAO 100.7 aircraft must have been calibrated either by the manufacturer or by a laboratory that is accredited with the National Association of Testing Authorities Australia or a similar national accreditation body that is a member of the International Laboratory Accreditation Cooperation within a period of 1 year before the weighing of any CAO 100.7 aircraft.

        (2)     For regulation 11.205 of CASR, the exemption is subject to the conditions mentioned in section 4.

4          Conditions

        (1)     The responsible person must weigh the CAO 100.7 aircraft using scales that, within a period of 1 year before the weighing of the aircraft, were calibrated by:

(a)   the manufacturer of the scales; or

(b)   an organisation that is approved by the National Measurement Institute for a purpose that covers the purpose of calibrating the scales; or

(c)   an organisation using a reference standard in respect of which there is:

             (i)  a valid certificate of verification issued under regulation 13 of the National Measurement Regulations 1999 as in force from time to time; or

            (ii)  a valid certificate of calibration (however described) issued by an accredited organisation.

        (2)     For paragraph (1) (c), a certificate for a reference standard is valid until the date of effect stated on the certificate or any date stated on the certificate by which the reference standard must be recalibrated or reverified.
