Exemption — operations by recreational aircraft in Townsville control zone and control areas and temporary restricted areas

1           Duration

                This instrument:

(a)     commences on 23 September 2009; and

(b)     stops having effect at the end of 27 September 2009.

2           Application

     (1)      This instrument applies to an aeroplane, being an aeroplane mentioned in Schedule 1:

(a)     to which Civil Aviation Order (CAO) 95.10 (a CAO 95.10 aeroplane), CAO 95.32 (a CAO 95.32 aeroplane) or CAO 95.55 (a CAO 95.55 aeroplane) applies; and

(b)     that is registered with Recreational Aviation Australia Incorporated (RAA), Aviation Reference Number 224806, or The Hang Gliding Federation of Australia Incorporated (HGFA).

     (2)      This instrument only applies to operations in the Townsville control zone and control areas and the temporary restricted areas established for the Townsville Airshow 2009 (the airshow).

3           Exemption

For this exemption, the operator of such an aeroplane is exempt from complying with the following provisions of CAR 1988:

(a)     Part 4 in the case of a CAO 95.10 aeroplane and a CAO 95.32 aeroplane;

(b)     regulations 36A and 37 in the case of a CAO 95.55 aeroplane;

(c)     Parts 4A, 4B, 4C, 4D and 5;

(d)     Part 7 in the case of a CAO 95.32 aeroplane;

(e)     subregulations 83 (1), (2) and (3) in respect of VHF equipment;

(f)      regulations 133, 139, 155 and 157;

(g)     regulation 210 as far as advertising of flying operations to qualify for a standard specified in the RAA Operations Manual is concerned;

(h)     regulation 230;

(i)      subregulation 242 (2);

(j)      regulation 252;

(k)     regulation 252A except in the case of a CAO 95.10 aeroplane;

(l)      regulation 322 in the case of a CAO 95.10 aeroplane.

4           Conditions

                The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 2             Conditions

        1      The conditions in this Schedule only apply to aeroplanes flying in the Townsville control zone, control areas and the temporary restricted areas declared for the Townsville Airshow 2009 under regulation 6 of the Airspace Regulations 2007.

        2      The aeroplane must comply with the conditions to which the aircraft is subject under CAO 95.10, CAO 95.32 or CAO 95.55, other than:

(a)     subparagraph 5.1 (e) in each CAO; and

(b)     subparagraphs 5.2 (a), (b), (d) and (e) in CAO 95.32 and CAO 95.55.

Note 1   Subparagraph 5.1 (e) prohibits flying inside an active prohibited or restricted area.

Note 2   Subparagraphs 5.2 (a), (b), (d) and (e) prohibit flying inside controlled airspace except in an aircraft of a certified design that complies with specific engine requirements and unless the pilot has a valid pilot’s licence (not being a student pilot’s licence) issued under Part 5 of CAR 1988 that allows the holder to fly in controlled airspace.

        3      In order to operate in a temporary restricted area, the aeroplane must be fitted with a radio capable of two-way communication with Air Traffic Control.

        4      The pilot in command must hold at least a valid RAA pilot certificate or HGFA pilot certificate, with radio operator endorsement.

        5      The pilot in command must comply with the procedures published in NOTAMS applicable to the airshow.
