CASA Ex68/07 – Exemption – from flight simulator user approval (Cth)

Exemption — from flight simulator user approval
1 Duration
This instrument:
(a) commences immediately after the commencement of Civil Aviation Order 40.2.1 Amendment Order (No. 1) 2007 (the CAO amendment); and
(b) stops having effect at the earlier of:
(i) the revocation of subsection 12A made by the CAO amendment; or
(ii) 2 years after the exemption commences.
2 Application
This instrument applies to each person (the holder) who:
(a) under subsection 12A of Civil Aviation Order 40.2.1 (CAO 40.2.1) uses an overseas flight simulator training provider to conduct an instrument proficiency check for the renewal of the holder’s grade of instrument rating; and
(b) complies with paragraph 12A.2 of CAO 40.2.1.
Note Under paragraph 12A.2 of CAO 40.2.1, at least 10 working days before undertaking an overseas instrument proficiency check mentioned in subparagraph 12A.1 (a) of CAO 40.2.1, the holder of a grade of instrument rating to be renewed would otherwise be required to give CASA details of the proposed instrument proficiency check.
3 Exemption
The holder is exempt from compliance with regulation 60.055 of CASR 1998.
Note Regulation 60.055 of CASR 1998 requires a person to obtain CASA approval to be the user of a qualified flight simulator in a training, testing or checking program.
