Exemption — operations without an approved digital flight data recorder

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 30 August 2011.

2          Application

            This instrument applies to the BAE 146-300 aeroplane with nationality and registration marks VH-NJZ, serial number E3126 (the aircraft), operated by National Jet Express Pty Ltd, trading as Cobham Aviation Services Australia – Regional Services, Aviation Reference Number 580965.

3          Exemption

The aircraft is exempt from compliance with subregulations 207 (2) and 21A (1) of CAR 1988 to the extent mentioned in Schedule 1.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1          Extent of exemption

               The instrument extends only to the directions:

(a) under subregulation 207 (2) of CAR 1988 that is contained in paragraph 6.2 of Civil Aviation Order 20.18; and

(b) under subregulation 21A (1) of CAR 1988 that is contained in Appendix 1 of Civil Aviation Order 103.19, in relation to the parameters, ranges, accuracy (minimum recorder and readout) and maximum recording intervals (seconds), as set out in the table below.

Schedule 2          Conditions

      1       For item 2, “Altitude”, the flight data recorder must record at a maximum recording interval of 2 seconds.

      2     For item 6, “Press to transmit”, the flight data recorder must record on VHF#1.

      3     For item 12, “Undercarriage squat or tilt switch”, the flight recorder is not requiredto record any squat (weight on wheels) discrete information.
