Authorisation — to carry out maintenance on warbirds

Exemption — to allow supervision of maintenance

1          Revocation

            Instrument CASA 436/07 is revoked.

2          Commencement

            This instrument commences the day after it is registered.

3          Application

            This instrument applies to the carrying out of maintenance on an aircraft of a type mentioned in Schedule 1 (a warbird), and to the supervision of that maintenance, when the aircraft is operated pursuant to:

(a)   a special certificate of airworthiness in the limited category; or

(b)   an experimental certificate.

4          Authorisation

             This instrument authorises a person who is supervised in accordance with Schedule 2 to carry out maintenance on a warbird.

5          Exemption

(1) The holder of an airworthiness authority who meets the requirements of clause 1 of Schedule 2 is exempt from compliance with subregulation 33B (4) of CAR 1988 to the extent set out in subsection (2).

   (2)     The holder is exempt from compliance with a condition of an airworthiness authority insofar as the condition prevents the supervision of maintenance in accordance with Schedule 2.

Schedule 1          Type of aircraft

            A type that has been manufactured in accordance with the requirements of, and accepted for use by, an armed force.

Schedule 2          Conditions

1                 The maintenance must be carried out under the supervision of a person who:

(a)   holds an airworthiness authority covering the maintenance; and

(b) is permitted by paragraph 42ZC (4) (a) or (b) of CAR 1988 to carry out the maintenance.

      2     In clause 1, supervision means:

(a)   being present in person and observing the supervised person performing maintenance on the aircraft, to the extent necessary to ensure that it is being performed properly; and

(b)   being immediately available in person to give advice to, or answer questions from, the supervised person about the maintenance that he or she is performing.
