Exemption — maximum take-off weight and installation of fuel system

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 31 January 2006.

2          Application

This instrument applies to the Cessna 208B aircraft:

(a)   bearing the nationality and registration marks VH-SHW (the aircraft); and

(b)   operated by Dick Smith Adventure Pty Ltd (the operator), Aviation Reference Number 086701; and

(c)   engaged in a return flight between Bankstown (New South Wales) and New Zealand (the operation).

3          Exemption

            The aircraft is exempt from compliance with:

(a) subregulations 235 (4) and (5) of CAR 1988; and

(b) regulation 42U of CAR 1988 in relation to the design and installation of the aircraft’s fuel system.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

      1     The aircraft must be fitted with a fuel system installed in accordance with Engineering Instruction Sheet No 201/263/EI 1 published by Auto Avia Design Pty Ltd.

      2     While the fuel system is installed, the aircraft may only be used for private operations.

      3     The operator must ensure that the aircraft is not occupied by more than 2 persons during the operation. 

      4     The operation must be carried out in accordance with Ferry Operating Instructions 201/263/FOS published by Auto Avia Design Pty Ltd.
