Exemption and permission — AOC holders with winching and rappelling privileges and the Australian Transport Safety Bureau (ATSB)

1          Duration

          This instrument:

(a)   commences on the day after registration; and

(b)   stops having effect at the end of 31 March 2015.

2          Application

          This instrument applies to:

(a)   the holder of an AOC which authorises the conduct of helicopter winching and rappelling operations (an eligible operator); and

(b)   ATSB when conducing accident investigations; and

(c)   the pilot in command of a helicopter operated by an eligible operator.

3          Exemption

The pilot in command of a helicopter operated by an eligible operator is exempt from the requirements of subregulations 151 (1) and 251 (3) of CAR1988 and paragraph 5.1 of Civil Aviation Order (CAO) 29.11 to the extent mentioned in Schedule 1.

4          Permission

          An eligible operator and the pilot in command of a helicopter operated by the eligible operator are permitted to carry ATSB personnel on or in part of the helicopter that is not designed for the accommodation of crew or passengers, or on, or in, anything attached to the helicopter for the purpose of emplaning or deplaning when carrying out accident investigations.

5          Conditions

          The exemption and permission are subject to the conditions mentioned in Schedule 2.

Schedule 1          Extent of exemption

             This exemption only applies to accident investigations which use the eligible operator’s helicopter and are conducted by ATSB.

Schedule 2          Conditions

        1   The helicopter operated by an eligible operator for winching and rappelling operations must not carry any persons other than the eligible operator’s crew and staff approved by the ATSB.

        2   All other requirements of CAO 29.11 must be complied with.
