Exemption — maintenance releases for class B aircraft

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of June 2009.

2          Application

            This exemption applies to:

(a)    the registered operator of a class B aircraft; and

(b)    an authorised person; and

(c)    the issue of a maintenance release for a class B aircraft engaged in private, or aerial work, operations.

3          Exemption

(1) The registered operator of a class B aircraft is exempt from the requirements in subregulation 41 (1) of CAR 1988 to ensure that all maintenance required to be carried out on a class B aircraft engaged in private, or aerial work, operations is carried out when required by the maintenance schedule.

(2) An authorised person is exempt from the requirements in paragraph 43 (7) (a) of CAR 1988.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

      1     The registered operator must ensure that the aircraft only operates under V.F.R. if maintenance required for the aircraft to operate under I.F.R. has not been completed.

      2     An authorised person must issue a maintenance release to an aircraft to operate only under V.F.R. if maintenance required to operate under I.F.R. is not completed.

      3     A maintenance release issued under clause 2 must be endorsed on the maintenance release.

4 The registered operator must ensure that all maintenance has been completed and certified in accordance with regulation 42ZE or 42ZN of CAR 1988 before the aircraft operates under I.F.R.
