Exemption — for aerial display of hang gliders

1          Duration

            This instrument:

(a)   commences at 6 a.m. local time on Tuesday, 3 January 2006; and

(b)   stops having effect at 7.30 p.m. local time on that day.

2          Application

This instrument applies to a glider, or a powered paraglider, having an empty weight not exceeding 70 kg (a hang glider), that is:

(a)   operating solely in private operations and only for recreational purposes (operations); and

(b)   officially participating in the air display conducted by the Hang Gliding Federation of Australia (the HGFA) at the Mystic Landing Area, Wandiligong Road, Bright, Victoria.

3          Exemption

Each hang glider mentioned in section 2, and each person who is in, on or otherwise associated with the operation of the hang glider is exempt from compliance with CASR 1998 and from the provisions of CAR 1988 mentioned in Schedule 1.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1          Provisions of CAR 1988

      1       Parts 4, 4A, 4B, 4C, 4D, 5 and 7.

      2     Subregulations 83 (1), (2) and (3) for VHF equipment.

      3     Part 11 (except regulations 140, 143, 144, 149, 150, 151, 152 and 153).

      4     Paragraphs 166 (2) (d), (e), (g) and (h) if, as far as practicable, the hang glider makes all turns in the established circuit direction when operating in the circuit area of a licensed, certified or registered aerodrome.

      5     Regulations 207 and 208.

      6     Regulation 210 for advertising of flying training to qualify for a pilot standard specified in the HGFA Operations Manual.

      7     Regulation 230.

      8     Regulation 252.

      9     Regulation 322.

Schedule 2          Conditions

      1     The hang glider must be operated as if the requirements of Civil Aviation Order 95.8 (CAO 95.8) applied to it, other than subparagraph 4.7 (k).

      2     The person who is in, on or otherwise associated with the operation of the hang glider must observe the requirements of CAO 95.8 as if it applied to the person, other than subparagraph 4.7 (k).
