Exemption — public address system
1 Duration
This instrument:
(a) commences on 1 August 2009; and
(b) stops having effect at the end of 31 July 2010.
2 Application
This instrument applies to the Cessna 404 Titan aircraft (the aircraft) operated by Skytrans Pty Ltd, trading as Skytrans Airlines, Aviation Reference Number 500705 (the operator).
3 Exemption
The operator and pilot in command of each aircraft are exempt from compliance with directions under subregulations 207 (2) and (3) and 252 (1) of CAR 1988 to the extent mentioned in Schedule 1.
4 Conditions
The exemption is subject to the conditions mentioned in Schedule 2.
Schedule 1 Extent of exemption
The exemption extends only to the requirements to comply with the directions in paragraph 4.3 of Civil Aviation Order 20.16.3 and paragraph 14.1.6 of Civil Aviation Order 20.11 that relate to the use of an approved and serviceable public address system for making announcements in emergencies and notifying passengers when a seat belt or safety harness is to be worn.
Schedule 2 Conditions
1 The number of passenger seats fitted to the aircraft must not exceed 12.
2 In any seating configuration no seats must be fitted behind the bench seat at row 6.
3 If the aircraft is engaged on a regular public transport operation and a flight is crewed by a single pilot, the operator must ensure that the number of passengers carried on the flight is not more than:
(a) 9 adult passengers; or
(b) 11 passengers of whom at least 2 are infants or children.
4 If passengers are carried on the aircraft:
(a) the passengers must remain seated with their seat belts fastened throughout the flight; and
(b) every passenger must receive a comprehensive briefing before take‑off and prior to landing and in an emergency situation as time permits.
