CASA EX58/19 — Carriage of Passengers on Proficiency Check and Flight Test Flights Instrument 2019
1 Name
This instrument is CASA EX58/19 — Carriage of Passengers on Proficiency Check and Flight Test Flights Instrument 2019.
2 Duration
This instrument:
(a) commences on the 1 June 2019; and
(b) is repealed at the end of 31 May 2022.
Note For regulation 11.250 of CASR, the directions in section 5 and Schedule 1 cease to be in force on the day that the instrument is repealed.
3 Application
This instrument applies in relation to the pilot in command of an aircraft that carries a passenger if the pilot conducts a proficiency check or a flight test of another pilot (the second pilot) in the aircraft and the pilot in command is 1 of the following:
(a) a flight examiner;
(b) a check pilot;
(c) a person approved under regulation 61.040 of CASR to conduct the check or test;
(d) an officer whose duties include the conduct of the check or test.
Note An officer, defined in the Act, means a member of the staff of CASA.
4 Exemption
The pilot in command of the aircraft is exempt from compliance with paragraphs 249 (1) (b) and (c) of CAR.
5 Direction — relating to carriage of passengers
The pilot in command of the aircraft is directed to comply with the requirements in Schedule 1.
Schedule 1 Requirements
1 In this Schedule:
sterile cockpit procedures means any procedures requiring pilots of the aircraft to refrain from non-essential activities during critical phases of flight.
2 If the passenger is not an officer, the pilot in command must ensure that the passenger:
(a) has applied for:
(i) appointment as a check pilot or for the issue of a flight examiner rating under Part 61 of CASR; or
(ii) approval to be a check pilot to conduct proficiency checks or flight tests; and
(b) observes the proficiency check or flight test as training or mentoring for such an appointment, rating or approval.
3 The pilot in command must ensure that, with respect to the passenger to be carried:
(a) it is a requirement of an approved training and checking organisation for the passenger, for his or her training or mentoring, to observe the conduct of a flight test or proficiency check; or
(b) CASA has approved a training program for the passenger with the pilot in command as his or her mentor; or
(c) the passenger is an officer who is on board the aircraft in the course of the officer’s duties relating to the conduct of the flight test or proficiency check.
4 The pilot in command must ensure that the passenger:
(a) does not occupy a control seat; and
(b) does not in any way interfere with the conduct of the proficiency check or flight test or with communication between the pilot in command and the second pilot; and
(c) minimises movement, noise and other distractions, and complies with any applicable sterile cockpit procedures.
5 The pilot in command must take into account the effect carriage of the passenger would have on the loading, weight and balance, and fuel load of the aircraft.
Note The pilot in command may refuse to carry the passenger if to do so would adversely affect the safety of the flight.
6 When conducting the proficiency check or flight test, the pilot in command must:
(a) limit flight manoeuvres to those:
(i) required for the proficiency check or flight test; and
(ii) mentioned in the Part 61 Manual of Standards, or required under CAR or CASR, as in force from time to time; and
(b) ensure that the demonstration of competence in emergency procedures and low flying are carried out only to the extent necessary for the proficiency check or flight test.
