Exemption — replacement components

1          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 30 November 2009.

2          Application

            This instrument applies to each person (the authorised person) who:

(a) is authorised for the purposes of subregulation 42ZC (3) or (4) of CAR 1988; and

(b)   replaces an aircraft component in the course of carrying out maintenance on class A or B Australian aircraft in Australian territory.

3          Exemption

            The authorised person is exempt from compliance with:

(a) paragraph 42W (2) (b) of CAR 1988; and

(b) paragraph 42W (4) (a) of CAR 1988.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

      1       The authorised person may replace an aircraft component in an aircraft with another aircraft component only if the replacement component:

(a)   is identical with the replaced component; or

(b) has been approved under regulation 36 of CAR 1988 as a replacement for the replaced component; or

(c)   is approved for use as a replacement for the replaced component:

             (i)  by the manufacturer of the aircraft or the replaced component; or

             (ii)  in a Parts Manufacturer’s Approval issued by the Federal Aviation Administration of the United States of America.

      2       The authorised person may replace an aircraft component in an aircraft with another aircraft component only if the replacement component:

(a)   has been manufactured under the approval issued under Subpart 21.F, 21.G, 21.K or 21.O of the Civil Aviation Safety Regulations 1998 (CASR 1998); and

(b)   either:

(i) is useable as a replacement in accordance with a design approved under CAR 1988 or CASR 1998; or

            (ii)  is specified in approved maintenance data for use as a replacement for the particular component that is replaced.
