Exemption — from provisions in Part 172 of CASR 1998

1          Revocation

            Instrument CASA EX10/06 is revoked.

2          Duration

            This instrument:

(a)   commences on the day after it is registered; and

(b)   stops having effect at the end of 31 January 2008.

3          Application

            This instrument applies to:

(a)   Airservices Australia (AA), Aviation Reference Number 202210; and

(b)   each AA controller;

            for an RNAV (RNP-AR) approach or departure by an RNP‑capable aeroplane.

4          Exemption

AA and each AA controller are exempt from compliance with each of the provisions in Part 172 of CASR 1998 mentioned in Schedule 1 and to the extent mentioned for each of the provisions.

Paragraph 172.065 (1) (a)

AA and each AA controller

(a)  the requirement in paragraph 12.2.1.2 (a) of the MOS that tracking instructions must be specified when standard instrument departures are not published; and

(b)  the requirement in paragraph 12.2.4.1 (b) of the MOS that a controller must not issue an air traffic clearance which authorises or requires a pilot to descend in I.M.C. below the lowest safe altitude (LSALT) for the route segment in a manner different from that specified in instrument approach landing charts published in AIP/FLIP Terminal; and

(c)  the requirement in paragraph 12.2.4.1 (c) of the MOS that a controller must not issue an air traffic clearance which authorises or requires a pilot to descend in I.M.C. below the LSALT for the route segment in a manner different from that specified in the approved instrument procedure published in NOTAM.
