Exemption — flight check system

1          Duration

            This instrument:

(a)   commences on the day after it is registered on the Federal Register of Legislative Instruments; and

(b)   stops having effect at the end of 30 June 2006.

2          Application

            This instrument applies to Heli-Aust Pty Ltd, Aviation Reference Number 401774 (the operator), for its operation of Bell 212 helicopters (the aircraft).

3          Exemption

The operator is exempt from compliance with regulation 232 of CAR 1988.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 1.

Schedule 1          Conditions

      1     The operator must:

(a)   hold a discrete AOC for the aircraft; and

(b)   comply with any conditions mentioned in it.

      2     The aircraft must have a flight check system that complies with the standards of the aviation authority of the country in which the aircraft is registered.

      3     The operator and the pilot in command must ensure that the normal and emergency checklists are available to the crew in flight.

      4     The pilot in command must ensure that the flight check system is carried out in detail.

      5     If the aircraft’s checklist information, procedures and instructions are contained in the aircraft’s flight manual, the flight manual:

(a)   may be taken to be the flight check system; and

(b)   must be available to the crew in flight.
