Exemption — from having training and checking organisation
1 Duration
This instrument:
(a) commences on the date after it is registered on the Federal Register of Legislative Instruments; and
(b) stops having effect at the end of 30 September 2008.
2 Application
This instrument applies to the operator of a single engine aircraft (the aircraft):
(a) with a maximum take-off weight of more than 5 700 kilograms; and
(b) that is employed in aerial work operations; and
(c) that is not employed in ambulance operations; and
(d) if the operator:
(i) does not hold an Air Operator’s Certificate that permits the carriage of passengers in the aircraft; and
(ii) is not specified by CASA under subregulation 217 (1) of CAR 1988.
3 Exemption
The operator is exempt from compliance with regulation 217 of CAR 1988.
4 Conditions
The exemption is subject to the conditions mentioned in Schedule 1.
Schedule 1 Conditions
1 The aircraft must:
(a) be used exclusively for aerial work purposes, other than ambulance functions, mentioned in paragraph 206 (1) (a) of the CAR 1988; and
(b) carry only crew members.
2 The operations in which the aircraft is employed must be conducted in accordance with the operator’s operations manual.
