Exemption — hang-gliding and paragliding operations at Hooley Dooley launch site within active restricted airspace at Williamtown, NSW

1          Duration

     This instrument:

(a)commences on the day of registration; and

(b)expires at the end of May 2016, as if it had been repealed by another instrument.

2          Application

This instrument applies to each pilot, being a member or guest member of the Newcastle Paragliding Club, and a financial member of the Hang Gliding Federation of Australia (HGFA), who operates a hang-glider or paraglider at Hooley Dooley launch site, north‑west of Vacy, New South Wales within military restricted airspace at Williamtown, New South Wales.

3          Definitions

In this instrument:

AGL means above ground level.

Duty Pilot means the member of Newcastle Paragliding Club responsible for overseeing and facilitating daily hang-gliding or paragliding operations.

AMSL means above mean sea level.

NM means nautical mile.

VHF means very high frequency.

4          Exemption

The pilot operating the hang-glider or paraglider is exempt from complying with paragraph 7.6 of Civil Aviation Order (CAO) 95.8.

5          Conditions

The exemption is subject to the conditions set out in Schedule 1.

Schedule 1          Conditions

1     Before commencing operations, all pilots must register with an official of the Newcastle Paragliding Club and be briefed by the Duty Pilot on the conditions set out in this Schedule.

2     The pilot must ensure that the aircraft is operated in accordance with CAO 95.8 other than paragraph 7.6.

3     The pilot must hold a valid pilot certificate, not being a student pilot certificate, issued by the HGFA.

4                 Operations within military restricted airspace at Williamtown, New South Wales, must be confined to within a 2 NM radius of the Hooley Dooley launch site and not extend eastwards beyond Summerhill Road, Vacy, New South Wales.

5     Before commencing each day of planned operations, the Duty Pilot must advise and obtain approval from Williamtown Control Tower.

6     After completing each day of planned operations, the Duty Pilot must advise Williamtown Control Tower that all operations have been completed.

7     The pilot must hold either a Flight Radio Operator’s Licence or a Radio Operator’s Endorsement issued by the HGFA.

8     The pilot must carry a VHF radio and monitor the frequency designated by Williamtown Control Tower.

9     Operations within restricted airspace, or within 5 NM outside of the restricted airspace boundary, must be below 5 000 feet AMSL.

10                 In the event of a radio failure or suspected radio failure, the pilot must not operate above 300 feet AGL within restricted airspace, or within 5 NM outside of the restricted airspace boundary.

11     Before commencing any operations, the Newcastle Paragliding Club and Williamtown Defence authority must sign a letter of agreement requiring compliance with this instrument and any other requirements specified by Williamtown Defence authority.
