Exemption — carriage of life rafts

1          Duration

            This instrument:

(a)   commences on the day after it is registered on the Federal Register of Legislative Instruments; and

(b)   stops having effect at the end of July 2008.

2          Application

            This instrument applies to Embraer EMB 120 and Fairchild 227-DC aircraft operated by Capiteq Limited (ACN 008 137 559), trading as AirNorth, Airlines of South Australia and Emu Airways in any of the following operations:

(a)   between Darwin (YPDN) and Dili (WPDL);

(b)   between Darwin (YPDN) and Baucau (WPEC);

(c)   between Darwin YPDN and Denpasar (WRRR);

(d)   between Broome (YBRM) and Dili (WPDL);

(e)   between Broome (YBRM) and Baucau (WPEC);

(f)    between Broome (YBRM) and Kupang (WRKK);

(g)   between Gove (YPGV) and Cairns (YBCS);

(h)   between Groote Eylandt (YGTE) and Cairns (YBCS).

3          Exemption

(1) The aircraft are exempt from compliance with directions under subregulation 252 (1) of CAR 1988 to the extent mentioned in subsection (2).

   (2)     The exemption applies only to the requirement to comply with paragraph 5.2.1 of Civil Aviation Order 20.11 in relation to the carriage of life rafts.

4          Condition

            The exemption is subject to the condition that the aircraft must be within the lesser of 60 minutes at single engine cruising speed, or 200 nautical miles, from an adequate aerodrome as defined in Civil Aviation Order 82.0.
