Exemption — validation flight checks

1          Duration

            This instrument:

(a)   commences on 2 August 2006; and

(b)   stops having effect at the end of 31 December 2007.

2          Application

            This instrument applies to Naverus Inc. (Naverus) for the flight validation of the RNAV (RNP-AR) terminal instrument flight procedure (TIFP) designed by Naverus under its procedure design certificate.

3          Exemption

Naverus is exempt from compliance with regulation 173.095 of CASR 1998 to the extent mentioned in Schedule 1.

4          Conditions

            The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 1          Extent of exemption

1The requirement that the validation pilot must be a CASA pilot.

      2     The requirements in the following provisions of Manual of Standards (MOS) Part 173 — Standards Applicable to the Provision of Instrument Flight Procedure Design (the MOS):

(a)   paragraph 6.1.2.4;

(b)   paragraph 6.1.2.5;

(c)   paragraph 7.1.5.3;

(d)   subsection 7.1.24.

Schedule 2          Conditions

1The Naverus RNAV (RNP-AR) TIFP must be validated by Mr Robert Kennedy (ARN 132218) (the validation pilot).

2The validation pilot must:

(a)   hold a current air transport pilot’s licence; and

(b)   hold a current instrument rating acceptable to CASA; and

(c)   have relevant experience in multi-engine IFR procedures; and

(d)   have adequate knowledge of the design of procedures in accordance with the MOS; and

(e)   have satisfactorily completed a flight validation course conducted by CASA; and

(f)    have satisfactorily completed a course in aerodrome lighting and visual approach slope guidance systems conducted by CASA; and

(g) be authorised to engage in low flying by a relevant and current low flying permit under paragraph 157 (4) (b) of the Civil Aviation Regulations 1988; and

(h)   have completed a procedure flight validation flight within the previous 12 months.

3The validation pilot must comply with:

(a)   the applicable requirements of the MOS; and

(b)   the requirements of the following Naverus documents current at the date of this instrument, or as varied with the written agreement of CASA:

             (i)  Recommended Practice for Required Navigation Performance (RNP) Procedure Validation; and

            (ii)  Naverus Regulatory Supplement: CASA Australia, Bulletin 06-01.

4CASA must be informed of all proposed validation activity, including any proposed use of a flight simulator, at least 7 days before it occurs.

5Naverus must allow CASA officers to observe all validation activity on request.
