Permission and exemption — dangerous goods and loose articles

1          Duration

            This instrument:

(a)   commences on 1 August 2006; and

(b)   stops having effect at the earlier of:

             (i)  the end of July 2008; or

            (ii)Bristow Helicopters Australia Pty Ltd (Aviation Reference Number 200267) (the operator) ceasing to carry out the operations mentioned in Schedule 1.

2          Application

            This instrument applies:

(a)   to the operator; and

(b)   to the persons mentioned in Schedule 1 (the personnel); and

(c)   for the operations, and in the aircraft, mentioned in Schedule 1 (the aircraft).

3          Permission

   (1)     The personnel may carry ammunition in the cabin of the aircraft.

   (2)     The operator may carry the ammunition of the personnel in the cabin of the aircraft.

4          Exemption

For the carriage of the weapons of the personnel as loose articles, the operator and the personnel are exempt from compliance with subregulation 235 (7A) of CAR 1988 in relation to directions in paragraphs 9.1 and 9.3 of Civil Aviation Order 20.16.3.

5          Conditions

             The permission and exemption are subject to the conditions mentioned in Schedule 2 which are necessary in the interests of safety.

Schedule 1          Solomon Islands operations

            Flights by the operator in AS 332 Super Puma helicopters for operations in the territory of the Solomon Islands carrying the following persons:

(a)   members of the Regional Assistance Mission to the Solomon Islands;

(b)   members of the Australian Defence Force;

(c)   members of an Australian State Police Force;

(d)   members of the Australian Federal Police.

Schedule 2          Conditions

      1     Before embarkation for flight, all weapons must be unloaded and confirmed to be unloaded by the person in command of the personnel.

      2     The personnel may carry ammunition in the cabin at the same time as a weapon only if:

(a)   the ammunition is carried on the person of the personnel so that it is secured in their webbing in a way approved by a superior officer of the personnel; and

(b)   before embarkation for the flight, the person in command of the personnel performs a drill, approved by a superior officer of the person, to check and confirm with the personnel that all ammunition is properly secured in their webbing.

      3     The operator must incorporate in its operations manual an appropriate standard operating procedure (SOP) that covers:

(a)   the loading, carriage and unloading of personnel carrying weapons, or weapons and ammunition, in an AS 332 Super Puma helicopter; and

(b)   any emergency drills that it considers necessary during the carriage of passengers with loose articles.

      4     Before flight, the operator must brief all personnel carrying weapons, or weapons and ammunition, under the permission or exemption on the terms of the SOP.
