Exemption and permission – Avalon Airshow 2015 – aircraft to be flown without radiocommunication systems

1          Duration

                 This instrument:

(a)   commences on 18 February 2015; and

(b)   expires at the end of 1 March 2015, as if it had been revoked by another instrument.

2          Application

                 This instrument applies to the aircraft mentioned in Schedule 1 (the replica aircraft) when flown in an approved part of the Australian International Airshow 2015 at Avalon, Victoria (the air display), and in rehearsals and media displays related to the air display.

3          Exemption

Each replica aircraft is exempt from compliance with regulation 82 of CAR 1988.

4          Permission

I give permission under subregulation 174A (3) of CAR 1988 for the replica aircraft to be flown under the V.F.R. without a radiocommunication system.

5          Conditions

                 The exemption and permission are subject to the conditions mentioned in Schedule 2.

Schedule 2          Conditions

        1     The replica aircraft must be operated in accordance with instructions from air traffic control (ATC) within Class D airspace at Avalon, Victoria that is under the control of Avalon Tower.

        2     The replica aircraft must not be flown if an aircraft, other than a replica aircraft, is operating within Class D airspace at Avalon, Victoria that is under the control of Avalon Tower.

        3     The pilot of the replica aircraft must be experienced in receiving and following instructions from ATC in the form of light signals.
