CASA EX32/19 — Seaplane and Amphibian Aeroplane Exemption 2019
1 Name
This instrument is CASA EX32/19 — Seaplane and Amphibian Aeroplane Exemption 2019.
2 Duration
This instrument:
(a) commences on 1 April 2019; and
(b) is repealed at the earlier of:
(i) the commencement of the Civil Aviation Safety Amendment (Part 91) Regulations 2018; or
(ii) 31 March 2022.
3 Definitions
Note In this instrument, certain terms and expressions have the same meaning as they have in the Act and the Regulations. These include: pilot in command, which is defined in the CASR Dictionary.
In this instrument:
relevant purpose means any of the following:
(a) to avoid an obstacle;
(b) to avoid undue noise over a populous area without compromising the aeroplane’s safety;
(c) for a single-engine seaplane or amphibian — to enable the aeroplane to land on water if its engine fails.
4 Exemption
(1) The pilot in command of either of the following kinds of aeroplane that is flown for a relevant purpose is exempt from compliance with paragraphs 166A (2) (d), (e) and (f) of CAR when the aeroplane is taking-off from, or landing on, water:
(a) a seaplane;
(b) an amphibian.
(2) The exemption in subsection (1) is subject to the condition in section 5.
5 Condition
The pilot in command may take-off from, or land on, water only if the pilot considers that, in the particular circumstances, it is safe not to comply with paragraph 166A (2) (d), (e) or (f) of CAR.
