Exemption — turns after take-off at the 2017 Australian International Airshow

1          Duration

                 This instrument:

(a)   commences on 23 February 2017; and

(b)   is repealed at the end of 5 March 2017.

2          Application

                 This instrument applies to the pilot in command (the participating pilot) of an aircraft that is participating in the 2017 Australian International Airshow (the Airshow) at Avalon aerodrome as organised by Aerospace Australia Limited, trading as Airshows Downunder, ARN 530518.

3          Exemptions

        (1)     The participating pilot is exempt from compliance with subregulation 167 (3) of the Civil Aviation Regulations 1988 (CAR) to the extent that the subregulation requires compliance with the rules in:

(a)   paragraph 167 (4) (a) of CAR; and

(b)   paragraph 167 (4) (b) of CAR; and

(c)   paragraph 167 (4) (c) of CAR.

Note 1   The exemption from compliance with paragraph 167 (4) (a) of CAR, therefore, provides that a pilot, after taking off from the aerodrome, is not obliged to maintain the same track while the aircraft is less than 500 feet above the terrain.

Note 2   The exemptions from compliance with paragraphs 167 (4) (b) and (c) of CAR, therefore, provide that a pilot is not obliged to make all their turns to the pilot’s left while the aircraft is flying in the circuit pattern for the aerodrome.

        (2)     The exemption is subject to the conditions in section 4.

4          Conditions

        (1)     The participating pilot must ensure safe separation from spectators and other aircraft:

(a)   after taking off from runway 18 or 19; and

(b)   while flying in the circuit pattern for Avalon aerodrome; and

(c)   after joining the circuit pattern for landing on runway 18 or 19 at Avalon aerodrome.

        (2)     A participating pilot must not make a left turn after take-off from runway 19 if another aircraft has commenced the take-off roll on runway 18.
