EXEMPTION UNDER SUBREGULATION 235 (11) RELATING TO LOADING OF FUEL ON CERTAIN AIRCRAFT USED BY THE ROYAL FLYING DOCTOR SERVICE

I, WILLIAM DAVID RICEMAN, Area Manager, Central Area Office, a delegate of CASA under subregulation 235 (11) of the Civil Aviation Regulations 1988 (CAR 1988) exempt the operator from compliance with the requirements under subregulation 235 (7) that are set out in paragraph 4.2 of section 20.9 of the Civil Aviation Orders for the purpose of loading fuel on  Pilatus PC-12 aircraft on condition that the operator must ensure that when fuel is being loaded:

(a)no passenger enters or leaves the aircraft;  and

(b)no passenger is on board the aircraft unless:

(i)his or her medical condition may deteriorate if he or she leaves the aircraft;  and

(ii)the requirements set out in Schedule 2 are met.

For the purposes of this instrument:

Pilatus PC-12 aircraft means each aircraft whose nationality and registration marks are set out in column 2 of an item in Schedule 1 and whose serial number is set out in column 3 of that item.

operator means the Royal Flying Doctor Service of Australia (Central Operations) Incorporated (Aviation Reference Number 038517).

passenger does not include a person who is on board the aircraft for the purpose of providing medical care.

This exemption stops having effect at the end of July 2006

CONDITIONS

  1. Before fuel is loaded on the aircraft, the operator must ensure that any passenger on board (other than a passenger whose age or medical condition prevents him or her from understanding the information) is told:

(a)that fuel is to be loaded;  and

(b)the location of the emergency exits;  and

(c)that he or she must not:

(i)smoke;  or

(ii)use any electrical equipment (other than medical equipment carried on the aircraft for the purpose);  or

(iii)do anything else that might cause fuel vapours to ignite during the loading.

  1. The operator must ensure that any passenger on board the aircraft complies with the instructions given under paragraph 1 (c).

  1. While fuel is being loaded on the aircraft, the operator must ensure that:

(a)the cabin door is open;  and

(b)if passenger loading equipment is available, it is in position at the door;  and

(c)the aircraft and the fuelling equipment are connected to an earth point;  and

(d)a cabin attendant, or a person who is on board the aircraft for the purpose of providing medical care, is on duty in the aircraft;  and

(e)the pilot in command of the aircraft is in the aircraft loading area, unless he or she is the person conducting the refuelling.
