Exemption – Pearl Aviation Australia Pty Ltd – low-level rating requirement

1          Duration

                 This instrument:

(a)   commences on the day of registration; and

(b)   expires at the end of August 2017, as if it had been repealed by another instrument.

2          Definitions

                 In this instrument:

operator means Pearl Aviation Australia Pty Ltd, Aviation Reference Number 411832.

operator’s T&C program means the operator’s training and checking program established under regulation 217 of the Civil Aviation Regulations 1988.

relevant low-level operation means a low-level operation in accordance with the operator’s AOC.

relevant pilot means the holder of a pilot licence who:

(a)   is employed under a contract of service or engaged under a contract for services by the operator; and

(b)   is authorised in writing by the operator to conduct a relevant low-level operation.

3          Application

                 This instrument applies to the operator.

4          Exemption

(1) A relevant pilot is exempt from the requirements of subregulation 61.375 (7) and item 5 of Table 61.375 of CASR 1998, to the extent that, to conduct a relevant low‑level operation in the exercise of the privileges of the pilot’s licence, the pilot is required to hold a low-level rating or an aerial application rating.

(2) A relevant pilot is exempt from the requirements of subregulation 61.065 (1) of CASR 1998, to the extent that it prohibits the pilot from conducting a relevant low-level operation in the exercise of the privileges of the pilot’s licence while not holding a low-level rating or an aerial application rating.

5          Conditions

                 The exemptions in section 4 are subject to the conditions mentioned in Schedule 1.

Schedule 1 — Conditions

        1     The relevant pilot must:

(a)   be a participant in the operator’s T&C program; and

(b)   successfully complete all training and checking requirements of the operator’s T&C program, including proficiency checks.

        2     At least once within the previous 12 months, under the operator’s T&C program, the relevant pilot must have successfully completed a specific proficiency check of low-level flying competency for relevant low-level operations.

        3     In any relevant low-level operation, the relevant pilot must conduct the operation in accordance with each part of the operator’s operations manual that deals with the operation or with an operation of that kind.

        4     The operator must ensure that the relevant pilot complies with clauses 1 to 3.
